Գերմանիայի կանցլեր Ֆրիդրիխ Մերցը, նախկինում՝ որպես ընդդիմության առաջնորդ, հազարավոր դիմումներ է ներկայացրել իր հասցեին հնչած վիրավորանքների համար քրեական պատասխանատվության ենթարկելու պահանջով։
Ըստ Welt am Sonntag-ի հետաքննության տվյալների, նա անձամբ ստորագրել է մինչև 4999 համարի դիմումները։ Հնարավոր խախտումները բացահայտելու համար Մերցն օգտվել է «So Done» մասնավոր ընկերության ծառայություններից, որը համակարգված կերպով մշտադիտարկում է համացանցը՝ քաղաքական գործիչների հասցեին հնչած վիրավորանքներ գտնելու նպատակով։ Ընկերությունը ստանում է գանձված տուգանքների և փոխհատուցումների 50 %-ը։
Մերցը բազմիցս ընդգծել է, որ գանձված բոլոր միջոցներն ուղղում է սոցիալական նպատակների իր հարազատ շրջանում։
Ներկայացված դիմումներից որոշները հանգեցրել են ոստիկանական խուզարկությունների։ Այսպես, դեպքերից մեկում հաշմանդամություն և հրեական արմատներ ունեցող կնոջից առգրավել են բջջային հեռախոսն այն բանից հետո, երբ նա Մերցին անվանել է «փոքրիկ նացիստ», թեև կինն անմիջապես ընդունել է իր մեղքը։ Մեկ այլ դեպքում դատարանը խուզարկությունն ապօրինի է ճանաչել, երբ հնչել էր «դողդոջուն հարբեցող» վիրավորանքը։ Տուժողի փաստաբանը խոսել է «իրավապահ մարմինների կամայականության» և «արդարադատության համակարգի թույլ տված ծայրահեղությունների» մասին։
Սկանդալն արժանացել է ամբողջ երկրի ուշադրությանը։ Բեռլինի դատախազները նույնիսկ հայհոյախառն գրառումները դիտարկել են որպես հանցագործություն և քաղաքական ծայրահեղականության դրսևորում։
Գերմանիայում համացանցի մշտադիտարկմամբ զբաղվող մասնավոր ընկերությունների զանգվածային ներգրավումը եզակի դեպք չէ։ Այնպիսի քաղաքական գործիչներ, ինչպիսիք են Մերցը, Ռոբերտ Հաբեկը կամ Մարի-Ագնես Շտրակ-Ցիմերմանը, ակտիվորեն դիմում են դրանց օգնությանը «ատելության և քարոզչության դեմ պայքարի» համակարգի շրջանակում, որը 2019 թվականից ակտիվորեն զարգանում է, գրում է լրատվամիջոցը։
Օրինակ, միայն «Hessen gegen Hetze» կազմակերպությունը 2025 թվականի առաջին տասն ամիսների ընթացքում ոստիկանությանն ու դատախազությանն է փոխանցել գրեթե 17 000 դեպք։
Չնայած հազարավոր հետաքննություններին՝ մեղադրական դատավճիռները հազվադեպ են։ Մոտ 30 գործ վարող փաստաբաններից մեկի տվյալներով, Մերցի դիմումներից միայն մեկն է ավարտվել տուգանքով, իսկ տասը գործ կարճվել է։
Գերմանիայում Սահմանադրական դատարանը բազմիցս ընդգծել է, որ քաղաքական գործիչները, իրենց դիրքի պատճառով, պետք է պատրաստ լինեն «ավելի շատ հանդուրժել վիրավորանքները», իսկ քրեական օրենսգրքի՝ «քաղաքական գործիչներին վիրավորելու» մասին հատուկ հոդվածը հակասում է այդ սկզբունքին։
