Սամվել Կարապետյանի փաստաբանների հրատապ ասուլիսից պարզ դարձավ, որ դատախազության կողմից առավել հրատապ ձևով ներկայացվել է վերաքննիչ բողոք՝ Սամվել Կարապետյանին ամեն գնով կալանավորելու պահանջով:
Միաժամանակ պարզ է դարձել, թե ուր են շտապում իրավապահները: Սամվել Կարապետյանի կալանքի ժամկետը լրանում է հունվարի 18-ին: Ըստ օրենքի, տնային կալանքի կիրառման դեպքում հնարավոր չէ կրկին կալանքի միջնորդությամբ հանդես գալ, այդ իսկ պատճառով մինչև կալանքի ժամկետի լրացումն ամեն գնով պետք է Վերաքննիչ դատարանի որոշում: Պաշտպանները հայտնեցին, որ Վերաքննիչն աննախադեպ կերպով ծայրահեղ հրատապությամբ է քննում բողոքը, և դատական ակտը հրապարակվելու է ոչ թե 10-օրյա, այլ 4-օրյա ժամկետում՝ հունվարի 16-ին, այսինքն՝ մինչև կալանքի ժամկետի լրանալը: Պարզ է դարձել նաև, որ նույնիսկ այդ շտապողականության պայմաններում իրավական խնդիր է առկա, քանի որ քննչական մարմինը ստիպված մուտք է արել տնային կալանքի, այլ ոչ կալանքի ժամկետի երկարաձգման միջնորդություն, բայց այն ամեն կերպ փորձում են թաքցնել, որպեսզի Վերաքննիչ դատարանում հաշվի չառնեն նշվածը և հնարավորինս արագ կայացնեն տնային կալանքը բեկանելու որոշում: Այսինքն, իրավապահ համակարգն իր ամբողջ ռեսուրսով կենտրոնացած է Սամվել Կարապետյանին ամեն գնով կալանավորելու վրա:
