Արբիտրաժային կազմը մերժել է Հայաստանի այն փաստարկները, ըստ որոնց՝ ՀԷՑ-ին վերաբերող վեճի նկատմամբ արտակարգ արբիտրաժի ընթացակարգի կիրառումը իրավաչափ չէ

«Հայաստանի էլեկտրական ցանցեր» ընկերության էքսպրոպրիացիայի (սեփականազրկման) վերաբերյալ ներդրումային վեճի քննության համար ձևավորված արբիտրաժային կազմը հաստատել է արտակարգ արբիտրի որոշման պարտադիր ուժը:
 
2025 թվականի հուլիսի 22-ին Ստոկհոլմի Առևտրի Պալատի (ՍԱՊ) կողմից նշանակված արտակարգ արբիտրը «Լիորմանդ Հոլդինգ Լիմիթեդ» ընկերության, Սամվել Կարապետյանի և նրա ընտանիքի դիմումի հիման վրա, պարտավորեցրել է Հայաստանի Հանրապետությանը ձեռնպահ մնալ «Հայաստանի էլեկտրական ցանցեր» ՓԲԸ-ին (ՀԷՑ) նկատմամաբ «Էներգետիկայի մասին» օրենքի և «Հանրային ծառայությունները կարգավորող մարմնի մասին» օրենքի այն դրույթների կիրառությունից, որոնք ընդունվել են 2025 թվականի հուլիսին, ինչպես նաև ձեռնպահ մնալ ցանկացած հետագա քայլերից, որոնք ուղղված են ՀԷՑ-ի էքսպրոպրիացիային (սեփականազրկման)։
 
Կողմերի միջև հիմնական վեճի քննության համար ձևավորված արբիտրաժային կազմը հստակ հաստատել է, որ ՍԱՊ-ի 2023 թվականի Արբիտրաժային կանոնակարգի II հավելվածի 9-րդ հոդվածի համաձայն՝ արտակարգ արբիտրի որոշումը պարտադիր է կողմերի համար և ենթակա է անհապաղ կատարման։
 
Միևնույն ժամանակ արբիտրաժային կազմը մերժել է Հայաստանի այն փաստարկները, ըստ որոնց՝ ՀԷՑ-ին վերաբերող վեճի նկատմամբ արտակարգ արբիտրաժի ընթացակարգի կիրառումը իրավաչափ չէ։
 
Արբիտրաժային կազմը նաև առանձին ընդգծել է, որ Հայաստանը չի դիմել որոշման չեղարկման կամ փոփոխման խնդրանքով։ Այս հանգամանքը լրացուցիչ հաստատում է Հայաստանի կողմից որոշման պարտադիր ուժի ճանաչումը։
 
Չնայած Հայաստանի Հանրապետության կողմից արտակարգ արբիտրի որոշման ակնհայտ խախտումներին, ներառյալ 2025 թվականի նոյեմբերին ՀԷՑ-ի լիցենզիայի դադարեցումը, արբիտրաժային կազմը որոշել է սկզբնական այս փուլում գնահատական չտալ այդ գործողություններին։
 
Միաժամանակ Հայաստանի Հանրապետության կողմից թույլ տրված բոլոր խախտումները կդիտարկվեն արբիտրաժային քննության ավելի ուշ փուլում՝ հիմնական վեճի քննարկման շրջանակում, և կգնահատվեն որպես Հայաստանի Հանրապետության կողմից Հայաստանի և Կիպրոսի միջև կնքված օտարերկրյա ներդրումների պաշտպանության մասին համաձայնագրի խախտումը ծանրացնող հանգամանքներ։
