«Տաշիր կապիտալը» դատարանին միջնորդել է կանխել ՀԷՑ–ի գույքը ձեռք բերելու գործընթացը

«Տաշիր կապիտալ» ՓԲԸ-ն դատարանին միջնորդել է կանխել կառավարության կողմից «Հայաստանի էլեկտրական ցանցեր» ընկերության գույքը ձեռք բերելու գործընթացը։ Դատարանի դիմաց լրագրողների հետ զրույցում այս մասին ասաց «Տաշիր կապիտալ» ՓԲԸ-ի ներկայացուցիչներից Վարդան Ալոյանը։
Նշենք, որ այսօր «Տաշիր կապիտալ» ՓԲԸ-ի և Հանրային ծառայությունները կարգավորող հանձնաժողովի գործով՝ «Հայաստանի էլեկտրական ցանցեր» ընկերությանը էլեկտրաէներգիայի բաշխման լիցենզիայից զրկելու առնչությամբ դատական առաջին նիստն է։
 
«Մեր կողմից միջնորդություն էր ներկայացվել հայցի ապահովում կիրառելու վերաբերյալ, քանի որ դատարանը այս գործը պետք է քննի 2–ամսյա ժամկետում, զուգահեռ նաև կառավարությունն էլ 3– ամսյա ժամկետում պետք է առաջարկ ներկայացնի ՀԷՑ-ի բաժնետոմսերը կամ գույքը ձեռք բերելու համար, մեր կողմից համապատասխան միջնորդություն է ներկայացվել վարչական վարույթը կասեցնելու հետ կապված, որ կառավարությանը թույլ չտան նման գործունեություն իրականացնել»,– մանրամասնեց Ալոյանը։
 
Փաստաբանի խոսքով` միջնորդել են նաև, որ ՀԷՑ–ի ժամանակավոր կառավարիչ նշանակված Ռոմանոս Պետրոսյանը որպես 3-րդ կողմ ներգրավվի գործում, քանի որ նա վարչական մարմին է, բայց ՀԷՑ-ի ներկայացուցիչը չէ ու ՀԷՑ-ը ներկայացնելու իրավասություն չունի։

«Դատարանը այս մասով մերժեց ու չթողեց երրորդ անձ ներգրավել, ինձ էլ չթողեց` ՀԷՑ–ը ներկայացնեմ, այլ որոշեց, որ ՀԷՑ-ին ներկայացնում է Ռոմանոս Պետրոսյանի կողմից լիազորված անձը, որը դատական նիստերին չի ներկայանում ու որևէ դիրքորոշում չի հայտնում»,- ասաց Ալոյանը։

Նրա խոսքով` ստացվում է, որ ՀԷՑ-ը փաստացի զրկված է դատական պաշտպանության իրավունքից, ինչպես որ վարչական վարույթի ընթացքում էր զրկված պաշտպանության իրավունքից:

Փաստաբան Արամ Օրբելյանն էլ հավելեց, որ իրենք ի սկզբանե հայցի ապահովման միջնորդություն ներկայացնելու մտադրություն չեն ունեցել, քանի որ գործը 2 ամսում պետք է ավարտվեր։

«Ակնհայտ էր, և մենք համոզված հիմնավորել էինք, որ որևէ խախտում չկա։ Բայց երբ կառավարության ներկայացուցիչը ժամանակ խնդրեց, որպեսզի ծանոթանա վիճակին և պատասխան ներկայացնի, այդ ժամանակ նոր մենք միջնորդեցինք»,- նշեց Օրբելյանը։

Նա ընդգծեց, որ ՀԷՑ-ի մասով օրենքի փոփոխության հետ սահմանադրական խնդիրներ են տեսնում։ Օրբելյանը հիշեցրեց, որ այժմ այս գործը Սահմանադրական դատարանում է, և բարձր դատարանը փետրվարի 4–ին կքննի գործը։

Հիշեցնենք՝ դեռ նախորդ տարի ՀԷՑ–ի ժամանակավոր կառավարիչ Ռոմանոս Պետրոսյանի հետ աշխատանքային հանդիպման ժամանակ Փաշինյանն ասել էր, որ ՀՀ կառավարությունը կքննարկի ՀԷՑ–ը և՛ պետականացնելու ու կոնցեսիոն կառավարման հանձնելու, և՛ այն կրկին հեղինակավոր ընկերության կողմից մասնավորեցնելու հնարավորությունները։ Դրանից հետո նա հայտարարել էր, որ եթե «Հայաստանի էլեկտրական ցանցերի» համար օբյեկտիվ գին որոշվի, որը կրելի կլինի ՀՀ պետական բյուջեի համար, պետությունն այն կսեփականաշնորհի։

Փաշինյանը կրկին նշել էր, որ իր համար ամենանախընտրելին առաջին տարբերակն է, ուստի մասնավոր ներդրողին կհրավիրեն միայն այն դեպքում, եթե ոչ ոք չհամաձայնի կոնցեսիոն կառավարում ստանձնել։
