Ովքե՞ր են ԱՄՆ–ից արտաքսված հայերը

Օրերս Երևանում վայրէջք է կատարել ԱՄՆ-ից ժամանած Boeing 767-300 ինքնաթիռը, որով Հայաստան են տեղափոխվել արտաքսված քաղաքացիները։ Լոս Անջելեսում գործող MI legal solutions գործակալության հիմնադիր, իրավաբան Լառա Կարեյանը NEWS.am–ի հետ զրույցում նշեց, որ խոսքն այն անձանց մասին է, ովքեր 2024 թվականի հունվարից հետո անօրինական կերպով հատել էին ԱՄՆ սահմանը, պահվում էին կալանավայրերում և որոնց վերաբերյալ դատարանն արդեն հրապարակել էր վերջնական վճիռը։
«Նրանք այն անձինք են, ովքեր կա՛մ չեն բողոքարկել դատարանի վճիռները, կա՛մ պարզապես իրենք են ցանկացել վերադառնալ իրենց քաղաքացիության երկիր։ Եղել են դեպքեր, երբ անձը գտնվել է միգրացիոն կալանավայրում և չի դիմացել կալանքի պայմաններին, ընտրել է բողոքարկումից հրաժարվելու կամ կամավոր վերադարձի տարբերակը»,–նշեց նա։
Լառա Կարեյանը նշեց, որ իրենք էլ տեղեկություն չունեն, թե այդ ինքնաթիռով քանի քաղաքացի է վերադարձել Հայաստան, սակայն միգրացիոն պահման կենտրոններում ավելի քան 3000 հայ կա։
«Իրավական առումով ոչինչ չի փոխվել Միացյալ նահանգներում, ուղղակի այս վարչակազմի ներդրած քաղաքականության արդյունքում միգրացայի հետ կապված կարգավորումները խստացել են։ Քաղաքացիներին ուղղակի խորհուրդ եմ տալիս խուճապի չմատնվել, և երբ միգրացիոն ծառայության կենտրոնի աշխատակիցն, օրինակ, փողոցում մոտենա, հարցնի՝ միգրացիոն ի՞նչ կարգավիճակում եք գտնվում, փաստաթղթեր պահանջել նրկայացնել, ազնիվ պատասխանել և փաստաթղթերը ներկայացնել։ Խոսքն այն մարդկանց մասին է, որոնց քաղաքական ապաստանի գործերն ընթացքի մեջ են»,–ասաց իրավաբանը։
Կարեյանի խոսքով սակայն, որևէ երաշխիք չկա, որ միգրացիոն ծառայությունում նշանակված հերթական հանդիպման ժամանակ այդ մարդկանց չեն ձերբակալի և չեն տեղափոխվի միգրացիոն կալանավայր՝ ապասատան ստանալու հայցերի քննությունը այնտեղից շարունակվելու։
«Այդպիսի դեպքեր շատ են եղել։ Խոսքը Մեքսիայի սահմանով ԱՄՆ եկած քաղաքացիների մասին է։ Նրանք տարեկան մեկ կամ երկու անգամ այցելում են միգրացիոն կենտրոններ։ Վիզայով ԱՄՆ եկած և ապաստան հայցած քաղաքացիներն այդ խնդիրը չունեն և մտահոգվելու առիթ էլ չունեն»,–նշեց իրավաբանը։
Հիշեցնենք, որ ԱՄՆ նախագահ Դոնալդ Թրամփն ավելի վաղ հայտարարել էր անօրինական միգրանտներին արտաքսելու խոշոր գործողություն իրականացնելու մտադրության մասին։ ԱՄՆ ներքին անվտանգության նախարար Քրիստի Նոեմն օրերս հայտնել էր, որ երկրի տարածքից 3 միլիոն միգրանտ է արտաքսվել, որոնցից 2,2 միլիոնը կամավոր են հեռացել։
