Մանկական, դպրոցական, գիտական կամ այլ գրականության օտարման գործարքները կազատվեն ԱԱՀ-ից՝ առանց նախարարության երաշխավորության. «Փաստ»

«Փաստ» օրաթերթը գրում է.

Ֆինանսների նախարարության՝ հանրային քննարկման ներկայացրած նախագծի կարգավորման առարկան մանկական գրականության, դպրոցական և ուսումնական հրատարակությունների, ինչպես նաև միաժամանակ որպես գիտական կամ ուսումնական և այլ հրատարակություն համարվող գրականության օտարման գործարքներն ԱԱՀ-ից ազատելու ընթացակարգն է:

Հարկային օրենսգրքի 64-րդ հոդվածի 2-րդ մասի 2-րդ կետի համաձայն՝ ԱԱՀ-ից ազատվում են դպրոցական գրերի և նոտայի տետրերի, նկարչական ալբոմների, մանկական և դպրոցական գրականության, դպրոցական ուսումնական հրատարակությունների, բուհերի, մասնագիտացված գիտական կազմակերպությունների, Հայաստանի գիտությունների ազգային ակադեմիայի հրատարակած գիտական և ուսումնական հրատարակությունների օտարումը։ Նույն կետով սահմանված արտոնությունների կիրառության շրջանակը սահմանում է կառավարությունը։

Կառավարության 2017 թվականի հոկտեմբերի 5-ի «Ավելացված արժեքի հարկից ազատման արտոնությունների կիրառության շրջանակները սահմանելու մասին» N 1317Ն որոշման 1-ին կետով սահմանված թիվ 1 հավելվածի 3-րդ, 4-րդ և 5-րդ կետերի վերջին նախադասությունների համաձայն՝ հրատարակչի կամ իրացնողի կողմից մանկական գրականության օտարումն ազատվում է ԱԱՀ-ից, եթե տվյալ գրականությունը ԿԳՄՍ նախարարությունը պաշտոնապես հաստատել կամ երաշխավորել է որպես մանկական, դպրոցական հրատարակությունների օտարումն ազատվում է ԱԱՀ-ից, եթե դրանք պաշտոնապես հաստատել կամ երաշխավորել է նախարարությունը` որպես դպրոցական, ուսումնական հրատարակությունների օտարումն ազատվում է ԱԱՀ-ից, եթե դրանք ևս պաշտոնապես հաստատել կամ երաշխավորել է նախարարությունը:

Նույն հավելվածի 10-րդ կետի համաձայն, այն հրատարակությունները, որոնք կարող են դասակարգվել և՛ որպես գիտական կամ ուսումնական, և՛ որպես այլ տիպի հրատարակություն, ԱԱՀ-ից ազատվում են, եթե դրանք նախարարությունը պաշտոնապես հաստատել է որպես գիտական և (կամ) ուսումնական հրատարակություն: Այսինքն, խնդրո առարկա գործարքների իրականացման դեպքում ԱԱՀ-ից ազատման արտոնությունը գործում է, եթե վերջիններիս վերաբերյալ առկա է նախարարության համապատասխան դիրքորոշումը:

Խնդիրն այն է, որ նախարարության ռեսուրսները հաճախ չեն բավարարում մեծ ծավալի հրատարակությունների բովանդակությունը կարճ ժամկետում ուսումնասիրելու և համապատասխան երաշխավորում տրամադրելու համար։ Արդյունքում, նախարարության երաշխավորումները տրամադրվում են ավելի երկար ժամկետներում, քան ԱԱՀ հաշվետու ժամանակաշրջանն է, ինչի արդյունքում այդ ընթացքում օտարված գրականության մասով խնդիրներ են առաջանում ԱԱՀ հաշվարկելու և վճարելու առումով, քանի որ դեռևս պարզ չի լինում, գործարքներն ազատված են ԱԱՀ-ից, թե ոչ։

Նախագծով առաջարկվում է ուժը կորցրած ճանաչել 2017 թվականի հոկտեմբերի 5-ի N 1317-Ն որոշման 1-ին կետով սահմանված թիվ 1 հավելվածի այն դրույթները, որոնցով մանկական գրականության, դպրոցական և ուսումնական հրատարակությունների, ինչպես նաև միաժամանակ որպես գիտական կամ ուսումնական և այլ հրատարակություն համարվող գրականության օտարման գործարքներն ԱԱՀ-ից ազատվելու համար պահանջվում է նախարարության տրամադրած երաշխավորություն։
