Քննչականը և դատախազությունը Սամվել Կարապետյանին հնարավորություն չեն տվել տեսաուղերձով հանդես գալ

Սամվել Կարապետյանի հրապարակային խոսքով հանդես գալու սահմանափակումը վերացվել է, սակայն տեսա կամ ձայնային ուղերձով հանդես գալու հնարավորությունը որևէ կերպ ամրագրված չէր։ Այս մասին 24News-ի հետ զրույցում ասաց փաստաբան Արամ Վարդևանյանը՝ անդրադառնալով այսօր կուսակցության շնորհանդեսին ԱԲ-ի կողմից ստեղծված Սամվել Կարապետյանի տեսաուղերձին և մամուլում շրջանառվող լուրերին։
Վարդևանյանը ընդգծեց, որ նշված հարցի վերաբերյալ դիմում-հարցում է ներկայացվել թե քննչական մարմնին, թե հսկող դատախազին, որպեսզի հնարավորություն ընձեռնվեր, որ Սամվել Կարապետյանը հրապարակային հենց տեսաձայնային ուղերձով հանդես գար։
«Սակայն քննչական մարմնից ստացված պատասխանը, ըստ էության, համարժեք էր մերժմանը, իսկ դատախազությունից մինչ օրս որևէ պատասխան չի ստացվել։ Ու, ելնելով այն իրավիճակից, որ Սամվել Կարապետյանի դեպքում շուրջ 200 օր կալանքն է եղել որպես խափանման միջոց, բացառապես «մեր ձևով եկեղեցու պաշտպանությանը մասնակցելու» արտահայտության համար, կարծում եմ, առավել քան հստակ է, թե փաստաբանական թիմը ինչ դիրքորոշում պետք է ունենար․ արդյոք նման տեսաուղերձը թույլատրելի կլինե՞ր, թե ոչ, արդյոք կհանդիսանա՞ր որպես խափանման միջոցի պայմանների հնարավոր խախտում, թե ոչ։
Դրա համար կարող ենք արձանագրել, որ քննչականը և դատախազությունը չեն տվել հնարավորություն Սամվել Կարապետյանին հանդես գալ տեսաուղերձով։ Բայց, միգուցե նաև հենց այս քննարկումը լավ առիթ է արձանագրելու այն, որ Կարապետյանի նկատմամբ քաղաքական հետապնդումը, որը սկիզբ է առել 2025 թվականի հունիսի 17-ին, արդեն վերածվել է մեկ այլ բնույթի քաղաքական հետապնդման, քանի որ Կարապետյանը, այլևս հանդիսանալով քաղաքական գործընթացի ակտիվ մասնակից, ունի անհավասար պայման՝ ելնելով հենց քաղաքական հետապնդումից, որն էլ իրականացվում է մեկ այլ քաղաքական ուժի կողմից ձևավորված իշխանության ներկայացուցիչների կողմից։ Հետևաբար՝ ստեղծված իրավիճակում, երբ խափանման միջոցն արդեն շուրջ 8 ամիս է, ինչ կիրառված է, և որևէ մեկ անգամ դրա նույնիսկ նվազագույն մեկնաբանման տիրույթում խախտման մասին խոսք չի եղել, ակնհայտ է, որ Կարապետյանի նկատմամբ կիրառված խափանման միջոցը պետք է վերացվի անհապաղ, նաև ելնելով քաղաքական և քաղաքացիական իրավունքների, մրցակցության, հավասարության երաշխիքների ապահովման տեսանկյունից»,- ասաց նա։
