Թուրքիայում 116 տարի անց վերահրատարակվել է Գրիգոր Զոհրապի «Քրեական իրավունք» աշխատությունը

Օսմանյան շրջանի հայտնի արևմտահայ իրավաբան, գրող և քաղաքական գործիչ Գրիգոր Զոհրապի 1909 թվականին հրատարակված «Hukuk-ı Ceza» (Քրեական իրավունք) աշխատությունը 116 տարի անց վերահրատարակվել է։ Գիրքը համարվում է օսմանյան-թուրքական քրեական իրավունքի հիմնարար աշխատություններից մեկը։
Զոհրապը (1861–1915) Երկրորդ սահմանադրական շրջանից հետո դասավանդել է Ստամբուլի իրավաբանական ֆակուլտետում և միաժամանակ եղել է Օսմանյան խորհրդարանի՝ Մեջլիս-ի Մեբուսանի Ստամբուլի պատգամավոր։ Նրա դասախոսությունների հիման վրա կազմված աշխատությունը ոչ միայն ուսումնական ձեռնարկ է, այլև կարևոր աղբյուր՝ ժամանակակից թուրքական քրեական իրավունքի ձևավորման գործընթացը հասկանալու համար։
Զոհրապը դեռևս 1891 թվականին հանդես էր գալիս պաշտպանական իրավունքի ամրապնդման օգտին՝ շեշտելով, որ մեղադրյալը չպետք է դատվի առանց փաստաբանի, իսկ նման հնարավորություն չունեցողներին պետությունը պետք է տրամադրի անվճար պաշտպան։ Նա նաև զգուշացնում էր, որ դատավորների վերահսկողությունից դուրս գործող լիազորությունները կարող են վտանգել արդար դատաքննությունը։
1906 թվականին սուլթան Աբդուլհամիդ II-ի օրոք Զոհրապին արգելվել է զբաղվել փաստաբանական գործունեությամբ, ինչից հետո նա մեկնել է Փարիզ։ 1908 թվականի սահմանադրության վերականգնումից հետո վերադարձել է Ստամբուլ և վերսկսել դասավանդումը։ 1909-ին նրա դասախոսությունները հրատարակվել են որպես 281 էջանոց աշխատություն՝ բաղկացած վեց հիմնական բաժիններից։
Գրքի նոր՝ 2025 թվականի հրատարակությունը պատրաստվել է թուրք փաստաբան Թուղայ Այդընի կողմից և լույս է տեսել «On İki Levha Yayıncılık» հրատարակչության կողմից՝ ակադեմիական շրջանակների մասնակցությամբ։ Գրքի անոտացիայում ընդգծվում է, որ «Hukuk-ı Ceza»-ն ժամանակակից թուրքական քրեական իրավունքի ձևավորման հիմնարար տեքստերից է։
Վերահրատարակությամբ Զոհրապի իրավագիտական ժառանգությունը կրկին հասանելի է դարձել հետազոտողների և իրավաբանների համար՝ բացելով նոր քննարկումների հնարավորություն թե՛ իրավունքի, թե՛ մտավոր պատմության ոլորտներում։
