«Փաստ» օրաթերթը գրում է.

Արդարադատության նախարարությունն առաջարկում է փոփոխություններ կատարել «Քրեակատարողական ծառայության մասին» օրենքում։ Քրեակատարողական ծառայողների ատեստավորման համակարգը բարելավելու նպատակով Արդարադատության նախարարի՝ 2025 թվականի օգոստոսի 14-ի N 530-Ա հրամանով ստեղծվել է աշխատանքային խումբ, որի ներկայացրած առաջարկությունների ամփոփման արդյունքում մշակվել է «Քրեակատարողական ծառայության մասին օրենքում փոփոխություններ կատարելու մասին» օրենքի նախագիծը։

Օրենքի 20.1 հոդվածի համաձայն՝ «Քրեակատարողական ծառայության գլխավոր, առաջատար, միջին և կրտսեր խմբերի ծառայողների ատեստավորումն անցկացվում է հավելավճար հաշվարկելու կամ հավելավճարի հաշվարկումը շարունակելու նպատակով»: Այսպես, գործող իրավակարգավորումների պայմաններում ատեստավորման ինստիտուտը հիմնականում դիտարկվում է որպես խրախուսման կամ հավելավճարի հաշվարկման մեխանիզմ։ Միևնույն ժամանակ հստակ ամրագրված չէ ատեստավորման առանցքային նպատակը՝ զբաղեցրած պաշտոնին ծառայողի համապատասխանության գնահատումը։ Մինչդեռ, համակարգում ատեստավորումը պետք է հանդիսանա ոչ միայն վարձատրության, այլև ծառայողի՝ իր զբաղեցրած պաշտոնին համապատասխանության վերահսկման գործիք։ Եթե օրենքով հստակ չի ամրագրվում, որ ատեստավորումը նպատակ ունի գնահատել ծառայողի համապատասխանությունը զբաղեցրած պաշտոնին, ապա այն փաստացի վերածվում է միայն հավելավճարի տրամադրման ընթացակարգի՝ զրկվելով բովանդակային նշանակությունից։

Պաշտոնների տարբեր խմբեր ենթադրում են տարբեր ծավալի լիազորություններ, տարբեր մակարդակի պատասխանատվություն և տարբեր մասնագիտական պատրաստվածություն։ Առանց զբաղեցրած պաշտոնին համապատասխանության պարբերական գնահատման հնարավոր չէ արձանագրել, որ ծառայողը շարունակում է բավարարել իր զբաղեցրած պաշտոնին ներկայացվող պահանջներին՝ մասնագիտական գիտելիքների և գործնական հմտությունների տեսանկյունից։

Սա հաշվի առնելով՝ անհրաժեշտություն է առաջացել օրենքում հստակ ամրագրել, որ ատեստավորումն անցկացվում է զբաղեցրած պաշտոնին համապատասխանությունը ստուգելու նպատակով: Դրանով պայմանավորված՝ անհրաժեշտություն է առաջացել փոփոխություն կատարել նաև ատեստավորման արդյունքներով տրվող եզրակացության վերաբերյալ իրավական նորմում՝ ամրագրելով, որ ատեստավորման արդյունքում կայացվում է հետևյալ եզրակացություններից մեկը՝ համապատասխանում է զբաղեցրած պաշտոնին և ենթակա է հավելավճար հաշվարկելու, համապատասխանում է զբաղեցրած պաշտոնին և ենթակա է շարունակելու հավելավճարի հաշվարկումը, համապատասխանում է զբաղեցրած պաշտոնին՝ առանց հավելավճար հաշվարկելու, համապատասխանում է զբաղեցրած պաշտոնին՝ առանց շարունակելու հավելավճարի հաշվարկումը, և չի համապատասխանում զբաղեցրած պաշտոնին:
