Արցախի դատական ակտը ճանաչվել է Հայաստանի դատարանի կողմից

2026 թվականի փետրվարի 25-ին ՀՀ Արարատի և Վայոց ձորի մարզերի առաջին ատյանի ընդհանուր իրավասության դատարանը ճանաչել և կատարման է թույլատրել Արցախի Հանրապետության դատարանի՝ ալիմենտի բռնագանձման վերաբերյալ դատական ակտը։ Այս մասին NEWS.am–ը տեղեկանում է Հելսինկյան քաղաքացիական ասամբլեայի Վանաձորի գրասենյակից։
Լեռնային Ղարաբաղից 2023 թվականին բռնի տեղահանված Զ․ Գ․-ը, խնամակալ էր դարձել անչափահաս երկու երեխաների համար։
Դեռևս 2019 թվականին Արցախի Հանրապետության ընդհանուր իրավասության առաջին ատյանի դատարանը բավարարել էր ալիմենտի բռնագանձման պահանջը, սակայն բռնի տեղահանությունից հետո անհրաժեշտություն էր առաջացել դատական ակտը ճանաչել արդեն Հայաստանի Հանրապետությունում, որպեսզի հնարավոր լինի շարունակել ալիմենտի ստացումը։
Այս իրավական խնդրի լուծման նպատակով Զ. Գ.-ը դիմել էր Հելսինկյան քաղաքացիական ասամբլեայի Վանաձորի գրասենյակ։ Կազմակերպությունը, ի դեմս ներկայացուցիչ Լիանա Մխոյանի, ստանձնել էր նրա շահերի պաշտպանությունը և 2025 թվականի նոյեմբերի 19-ին դիմում ներկայացրել ՀՀ Արարատի և Վայոց ձորի մարզերի առաջին ատյանի ընդհանուր իրավասության դատարան։
Ուսումնասիրելով գործի նյութերը՝ դատարանը բավարարել է դիմումը՝ թույլատրելով արցախյան դատական ակտի կատարումը Հայաստանում։
Այս որոշումը կարևոր է բռնի տեղահանված անձանց իրավունքների պաշտպանության և դատական պաշտպանության շարունակականության ապահովման տեսանկյունից՝ փաստելով, որ տեղահանության հետևանքով քաղաքացիները չպետք է զրկվեն իրենց և իրենց երեխաների կենսական իրավունքներից։
