Վաշտի հրամանատարին մեղադրանք է առաջադրվել

Երկրորդ կայազորային քննչական բաժնում քննվող քրեական գործով փետրվարի 17-ին մեղադրանք է առաջադրվել զորամասի հետախուզական վաշտի հրամանատարին՝ մարտական հերթապահության կանոնները խախտելու համար, որը պատճառել է ծանր հետևանքներ:
2015 թ. դեկտեմբերի 18-ին՝ ժամը 03:40-ի սահմաններում, հակառակորդի դիվերսիոն-հետախուզական խումբը հարձակում է իրականացրել N զորամասի պահպանության շրջանի մարտական հենակետերի ուղղությամբ: Մարտական գործողությունների արդյունքում ստացած հրազենային վնասվածքներից զոհվել են պարտադիր ժամկետային զինծառայողներ, շարքայիններ Աղասի Արսենի Գրիգորյանը և Ռուբեն Ռոբերտի Ալեքսանյանը: Հրազենային վիրավորումներ են ստացել և զինվորական հոսպիտալ տեղափոխվել մի քանի զինծառայող։
Երկրորդ կայազորային քննչական բաժնում նույն օրը հարուցվել է քրեական գործ՝ կազմակերպված խմբի կողմից, ազգային, ռասայական կամ կրոնական ատելության կամ կրոնական մոլեռանդության շարժառիթով, սպանելու նպատակով, ապօրինաբար երկու և ավելի անձանց դիտավորությամբ կյանքից զրկելու, երկու և ավելի անձանց դիտավորությամբ կյանքից զրկելու փորձ կատարելու դեպքի առթիվ:
Քրեական գործով ձեռնարկվել են անհրաժեշտ քննչական գործողություններ՝ դեպքի բոլոր հանգամանքների բազմակողմանի, օբյեկտիվ և լրիվ հետազոտումն ապահովելու ուղղությամբ։
Նախաքննությամբ պարզվել է, որ հետախուզական վաշտի հրամանատար, կոչումով կապիտանը 11.12.2015 թվականից նշանակվել է զորամասի պահպանության տեղամասի մարտական դիրքի թիկունքում՝ որպես ավագ, որի ընթացքում խախտել է մարտական հերթապահության կրման կանոնները։
Նախնական քննության տվյալներով՝ կապիտանը դրսևորել է անգործություն, չի իրականացրել և կազմակերպել դարանակալմանն ուղղված անհրաժեշտ գործողություններ, ու դեկտեմբերի 17-ին՝ ժամը 23:30-ի սահմաններում, հավելյալ տեղեկանալով հակառակորդի դիվերսիոն-հետախուզական խմբի ներթափանցման վերաբերյալ՝ շարունակել է նույն վարքագիծը, որպիսի պայմաններում դեկտեմբերի 18-ին՝ ժամը 03:40-ի սահմաններում, հակառակորդի դիվերսիոն-հետախուզական խումբն անարգել ներթափանցել է նշված դիրքի թիկունք ու հարձակման ենթարկել զինծառայողներին, ինչի հետևանքով առաջացել են ծանր հետևանքներ։
Ձեռք բերված ապացույցների հիման վրա՝ կապիտանին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 365-րդ հոդվածի 3-րդ մասով (մարտական հերթապահություն կամ մարտական ծառայություն կրելու կանոնները խախտելը, որը պատճառել է ծանր հեևանքներ)։ Նույն օրը քննիչը միջնորդություն է ներկայացրել դատարան՝ նրա նկատմամբ որպես խափանման միջոց կալանավորումը կիրառելու վերաբերյալ, ինչը բավարարվել է։
Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցվածչէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
