Փաստաբան Լիանա Գասպարյանը NEWS.am–ի հետ զրույցում անդրադարձել է ՔԿ–ի այն հաղորդագրությանը, որ «Ուժեղ Հայաստան»-ի պատգամավորի թեկնածու Աշոտ Եղիազարյանը կալանավորվել է՝ 100-ից ավելի ընտրողի ընտրակաշառք տալու համար։
Մամուլում տարածվել է տեղեկատվություն, որ կալանավորվել է «Ուժեղ Հայաստան»-ի պատգամավորի թեկնածու Աշոտ Եղիազարյանը և իբրև վերջինիս մեղադրանք է առաջադրվել 100-ից ավելի անձանց ընտրակաշառքի վերաբերյալ, տիկին Գասպարյան ինչ կարող եք հայտնել նշվածի մասին որպես Ա. Եղիազարյանի պաշտպան։
Նախ ցանկանում եմ արձանագրել, որ ներկայացված մեղադրանքը հիշեցնում է ֆանտաստիկ ֆիլմի սցենար: Ցանկացած անձի կարող են նման մեղադրանք առաջադրել պարզաբանեմ ինչու: Աշոտ Եղիազարյանը որևէ առնչություն չունի նման արարքի հետ, հետևաբար այնպես ինչպես Եղիազարյանին են վերագրել նման դեպք, կարող են վերագրել ցանկացած անձի: «Ուժեղ Հայաստան»-ի դեպքում այլևս իրավունքը տրորելու նոր նշաձող է սահմանվել: Աշոտ Եղիազարյանը, ով նախկինում երբևէ արատավորված չի եղել, երբևէ չի թաքնվել իրավապահներից, իր նախաձեռնությամբ մշտապես հասանելի է եղել իրավապահների համար այս պահին կալանավորված է: Այսինքն կալանքի պայմաններից որևէ մեկը չէր կարող վերագրվել Եղիազարյանին:
Ի դեպ Եղիազարյանի կալանքի հարցի քննության, դատական նիստի ընթացքում, առանց նախաքննական գաղտնիք հրապարակման պարզապես նշեմ վերագրվող մեադրանքներն ամբողջությամբ հերքվել են: Կարող եմ նույնիսկ ասել, որ բազմաթիվ անձանց են հարցաքննել և դրանց արդյունքները ցանկացած անաչառ դիտորդի մոտ կստեղծի համոզմունք, որ այստեղ քրեական գործ չկա, առավելևս ընտրակաշառքի, կամ որևէ այլ անօրինական արարքի վերաբերյալ մեղադրանք: Վստահ եմ նկատած կլինեք, որ այս դեպքում նույնիսկ որևէ աղմկահարույց ձայնագրություն Ա. Եղիազարյանի իբրև մասնակցությամբ չի եղել: Իրավապահները պարզապես արդեն որոշել են, որ նույնիսկ քարոզչական նպատակով որևէ մեկի հետ հաղորդակցումը դա ևս ապօրինի է:
Ավելին ցանկանում եմ նշել նաև, որ նախընտրական շրջանում եթե որևէ մեկը օրինակ հարսանիք պլանավորի և հյուրերի ցանկ գրի, դա դիտարկվելու է ընտրական հանցանք, քանի որ եթե կա ցուցակ, եթե կա անձանց անուն ազգանուն ապա դա այլևս ըստ քննչական մարմնի ապօրինություն է:
Մենք բողոքարկելու ենք կալանավորման վերաբերյալ դատական ակտը և դրա համար ունենք բազմաթիվ հիմքեր և հիմնավորումներ: Այս ամենը որևէ օրինական, դատավարական նպատակ չի հետապնդում, հետևաբար այս ամենի պատասխանները լրիվ այլ իրավունքից դուրս տիրությում են:
