Ի՞նչ կարգավորումներ կգործեն փաստացի գոյություն չունեցող կամ մեկ այլ անձի տիրապետման տակ գտնվող և չօգտագործվող մեքենաների սեփականատերերի համար. «Փաստ»

«Փաստ» օրաթերթը գրում է.

Ներքին գործերի նախարարությունը հանրային քննարկման է ներկայացրել «Տրանսպորտային միջոցները խոտանված համարելու և տրանսպորտային միջոցների սեփականության իրավունքի պետական գրանցման և պետական հաշվառման (վերահաշվառման) համակարգչային շտեմարանից
հանելու մասին» նախագիծը։ 

Նախագծի ընդունման անհրաժեշտությունը պայմանավորված է չշահագործվող (առանց համապատասխան փաստաթղթավորման օտարված և (կամ) ըստ էության փաստացի գոյություն չունեցող) տրանսպորտային միջոցների՝ ՆԳՆ էլեկտրոնային ռեգիստրում գրանցումը կասեցնելու և դրանց սեփականատերերի նկատմամբ ԱՊՊԱ պայմանագիր չունենալու համար վարչական պատասխանատվություն չկիրառելու, ինչպես նաև գույքահարկի գծով պարտավորություններ չհաշվարկելու հանգամանքով:

«Ավտոտրանսպորտային միջոցների օգտագործումից բխող պատասխանատվության պարտադիր ապահովագրության մասին» օրենքի համաձայն՝ բոլոր հաշվառված տրանսպորտային միջոցների սեփականատերերը պարտավոր են ունենալ գործող ԱՊՊԱ պայմանագիր, իսկ չունենալու դեպքում, Վարչական իրավախախտումների վերաբերյալ օրենսգրքի 129.2-րդ հոդվածի 1-ին մասի համաձայն, ենթակա են վարչական պատասխանատվության: Բացի այդ, հարկային օրենսգրքի համաձայն, այդ տրանսպորտային միջոցների համար առաջանում են գույքահարկի գծով պարտավորություններ:

Արդյունքում քաղաքացիները հայտնվում են փաստացի գոյություն չունեցող կամ մեկ այլ անձի տիրապետման տակ գտնվող և չօգտագործվող գույքի համար ԱՊՊԱ պայմանագիր չունենալու համար վարչական պատասխանատվության ենթարկվելու և գույքահարկ վճարելու իրավիճակում՝ չունենալով դրանից օրինական եղանակով ազատվելու որևէ օբյեկտիվ հնարավորություն:

Նշված խնդիրներին լուծում տալու համար մշակվել է «Տրանսպորտային միջոցները խոտանված համարելու և տրանսպորտային միջոցների սեփականության իրավունքի պետական գրանցման և պետական հաշվառման (վերահաշվառման) համակարգչային շտեմարանից հանելու մասին» կառավարության որոշման նախագիծը, որով նախատեսվում է 2023 թվականի հոկտեմբերի 1-ի դրությամբ խոտանված համարել և ՆԳՆ էլեկտրոնային ռեգիստրի գործող հատվածից հանել այն տրանսպորտային միջոցները, որոնց համար 2023 թվականի հոկտեմբերի 1-ից մինչև այս որոշումն ուժի մեջ մտնելը չի կնքվել ավտոտրանսպորտային միջոցների օգտագործումից բխող պատասխանատվության պարտադիր ապահովագրության պայմանագիր, այդ տրանսպորտային միջոցով կատարված որևէ իրավախախտման դեպք չի արձանագրվել, դրանք չեն անցել տեխնիկական զննություն, դրանց համար գույքահարկ չի վճարվել, տրանսպորտային միջոցների սեփականության իրավունքի պետական գրանցման և պետական հաշվառման (վերահաշվառման) էլեկտրոնային ռեգիստրում որևէ գործողություն չի կատարվել:

Նախագծի ընդունմամբ փաստացի գոյություն չունեցող կամ մեկ այլ անձի տիրապետման տակ գտնվող և չօգտագործվող տրանսպորտային միջոցների սեփականատերերը կազատվեն «Ավտոտրանսպորտային միջոցների օգտագործումից բխող պատասխանատվության պարտադիր ապահովագրության մասին» օրենքով նախատեսված ԱՊՊԱ պայմանագիր կնքելու և հարկային օրենսգրքով նախատեսված գույքահարկ վճարելու պարտավորությունից:
