Վերջին օրերին քաղաքական օրակարգի ամենաքննարկվող թեմաներից մեկը դարձել է ՀՀ երկրորդ նախագահ Ռոբերտ Քոչարյանի նկատմամբ նոր քրեական վարույթ նախաձեռնելու իրավապահների որոշումը։ Թեև շատերի համար դրա պատճառներն ակնհայտ են թվում՝ հաշվի առնելով վերջին տարիներին ընդդիմադիր գործիչների նկատմամբ հարուցված բազմաթիվ աղմկահարույց գործերը, այնուամենայնիվ հետաքրքրություն է առաջացնում հասկանալ, թե այս անգամ ինչի մասին է խոսքը։

Պարզվում է՝ քննության առարկա է դարձել ավելի քան երկու տասնամյակ առաջ՝ շուրջ 22 տարի առաջ կայացված կառավարական որոշումը։ Ըստ շրջանառվող տեղեկությունների՝ նախկին նախագահին վերագրվող հիմնական գործողությունն այն է, որ նա իր ստորագրությամբ հաստատել է կառավարության ընդունած որոշումը։

Սակայն հենց այստեղ էլ սկսվում են բազմաթիվ հարցադրումները։ Խնդիրն այն չէ միայն, որ խոսքը վերաբերում է վաղեմության չափազանց մեծ ժամկետ ունեցող իրադարձության։ Իրավական տեսանկյունից ևս առաջանում են լուրջ տարակուսանքներ։

Բանն այն է, որ տվյալ ժամանակահատվածում գործող Սահմանադրությամբ և օրենսդրությամբ Հանրապետության նախագահը պարտավոր էր վավերացնել կառավարության ընդունած որոշումները։ Դա նախագահի լիազորությունների և սահմանադրական պարտականությունների շրջանակում էր։ Միաժամանակ նախագահը չուներ կառավարության որոշումների նկատմամբ վետո կիրառելու կամ դրանք մերժելու իրավասություն։

Այս հանգամանքը նշանակում է, որ քննարկվող գործողությունը, ըստ էության, նախագահի կողմից իր սահմանադրական պարտականությունների կատարումն էր։ Հետևաբար առաջանում է հարց՝ որքանով է հնարավոր պատասխանատվություն պահանջել մի գործողության համար, որը տվյալ պահին օրենքով նախատեսված պարտադիր ընթացակարգ է եղել։

Բացի այդ, իրավաբանների շրջանում քննարկվում է նաև վաղեմության հարցը։ Շատերի գնահատմամբ՝ եթե նույնիսկ տեսականորեն գոյություն ունենային իրավական խնդիրներ, ապա համապատասխան ժամկետներն արդեն վաղուց սպառված են։

Այս ամենի ֆոնին իշխանությունների հերթական նախաձեռնությունը բազմաթիվ մեկնաբանների կողմից դիտարկվում է որպես իրավական հիմքերի առումով խոցելի գործընթաց։ Քննադատների կարծիքով՝ այնպիսի գործ է շրջանառության մեջ դրվում, որը հեշտությամբ կարող է վիճարկվել թե՛ իրավական, թե՛ տրամաբանական հարթություններում։

Ինչու է հենց հիմա կրկին ակտիվացվել այս թեման, արդեն առանձին քաղաքական քննարկման նյութ է։ Սակայն ակնհայտ է, որ նախաձեռնությունը հերթական անգամ լայն բանավեճ է առաջացրել թե՛ իրավական, թե՛ քաղաքական շրջանակներում։
