ՍԴ-ն քննում է ընտրությունների արդյունքները վիճարկող քաղաքական 7 ուժերի դիմումները (թարմացվող)

Սահմանադրական դատարանում մեկնարկել է ԱԺ ընտրությունների արդյունքները վիճարկող քաղաքական յոթ ուժերի դիմումների քննությունը:
Սահմանադրական դատարանի որոշմամբ դատավորներ Վլադմիր Վարդանյանը և Արտակ Զեյնալյանը չեն մասնակցում դիմումների քննությանը:
Ըստ ավելի վաղ հրապարակված փաստաթղթի՝ Վարդանյանի և Զեյնալյանի մասնակցությունը գործի քննությանն անհնարին է, քանի որ նրանք «կանխակալ վերաբերմունք ունեն» դատավարության կողմերի նկատմամբ:
Այսպիսով՝ ընտրությունների արդյունքների վիճարկման քննությանը մասնակցում են ՍԴ 9 դատավորներից 7-ը, այդ թվում՝ Սեդա Սաֆարյանը:
Ավելի վաղ «Հայաստան» դաշինքից դիմում էին ներկայացրել բարձր ատյան, որպեսզի դատավոր Սեդա Սաֆարյանի մասնակցությունն այսօր մեկնարկելիք դատավարությանը ճանաչվի անհնարին՝ կողմնակալության հիմքով: Սահմանադրական դատարանը քննության առարկա չի դարձրել դատավոր Սեդա Սաֆարյանի վերաբերյալ հարցը:
Սեդա Սաֆարյանը 2021 թվականի խորհրդարանական ընտրություններում ընդգրկված էր «Շիրինյան-Բաբաջանյան ժողովրդավարների դաշինք»-ի ցուցակում:
Արման Բաբաջանյանի «Հանուն Հանրապետության» կուսակցությունը ևս Սահմանադրական դատարանում բողոքարկում է ընտրությունների արդյունքները, իսկ 2021-ին Բաբաջանյանը Սաֆարյանի հետ նույն դաշինքում էր:
Դատավարությանը հիմնական պատասխանող է Կենտրոնական ընտրական հանձնաժողովը, որպես երրորդ անձ մասնակցում է «Քաղաքացիական պայմանագիրը», հարակից պատասխաններով հանդես կգան դատախազության, ներքին գործերի նախարարության և հակակոռուպցիոն կոմիտեի ներկայացուցիչները:
Փաստաբան Արամ Օրբելյանը միջնորդեց, որպեսզի գործի քննությունը շարունակվի ամբողջ կազմով. «Սահմանադրությունը երաշխավորում է Սահմանադրական դատարանի կողմից գործի քննություն, Սահմանադրական դատարանը համապատասխանաբար ունի 9 անդամ, 9 անդամի քանակի փոփոխությունը, որը նախատեսված է Սահմանադրական օրենքով, բայց չի նախատեսված Սահմանադրությամբ, առաջացնում է մի իրավիճակ, որ գործի քննությունը հիմա իրականացվում է ոչ թե Սահմանադրական դատարանի կողմից, այլ Սահմանադրական դատարանի կրճատված կազմի կողմից, ինչն առաջացնում է որոշակի խնդիր՝ որոշումների ընդունման կառուցակարգի հետ կապված»:
