Իրավակարգի և ժողովրդի միջև օրգանական կապի բացակայությունն է պատճառը, որ ՀՀ-ն երկար ժամանակ չի ընկալվել որպես սեփական քաղաքացիների անվտանգությունը, ազատությունն ու բարեկեցությունն ապահովելու գործիք։ Այս մասին նշված է Նիկոլ Փաշինյանի՝ Սահմանադրության օրվան նվիրված ուղերձում։

«Սիրելի՛ ժողովուրդ, Հայաստանի Հանրապետության սիրելի՛ քաղաքացիներ,

Այսօր՝ հուլիսի 5–ին, նշում ենք Սահմանադրության օրը։ Սահմանադրության առանցքային նշանակությունը ոչ միայն երկրում իրավակարգի, սահմանադրական կարգի հաստատումն է, այլև այդ կարգի ծագումնաբանության, օրգանական կապի ապահովումը պետության հիմնադիրի, ինքնիշխանի, այսինքն` ժողովրդի հետ։

Սահմանադրությունը երկրում մարդկանց ապրելու կանոններ է սահմանում և էական է, թե ով և ինչպես է այդ կանոնները սահմանել։ Դրանք պետք է սահմանված լինեն ժողովրդի կամքով, ժողովրդի ազատ կամարտահայտմամբ, և սա պետության կայունության ու զարգացման կարևոր նախապայման է։ Այս պայմանը մեր անկախությունից ի վեր էականորեն խախտված է, և Հայաստանի Հանրապետության ժողովուրդը չունի այն զգացողությունը, թե երկրում հաստատված իրավակարգն իրենից է բխում։

Իրավակարգի և ժողովրդի միջև օրգանական կապի բացակայությունն է նաև պատճառը, որ Հայաստանի Հանրապետությունը երկար ժամանակ չի ընկալվել որպես սեփական քաղաքացիների անվտանգությունը, ազատությունն ու բարեկեցությունն ապահովելու գործիք, և 2024 թվականից որդեգրված քաղաքականություններով՝ Կառավարությունն ու կառավարող մեծամասնությունը հենց այս բացը լրացնելով են զբաղված, մի քաղաքականություն, որ տալիս է իր տեսանելի արդյունքը, իսկ 2026 թվականի ԱԺ հերթական ընտրություններում այն ստացավ ժողովրդի վստահության քվեն։

Ընտրությունների արդյունքներով ձևավորված մեծամասնության նախընտրական ծրագիրը նաև նոր Սահմանադրության ընդունման օրակարգն է ներառում։

Սիրելի՛ ժողովուրդ, Հայաստանի Հանրապետության սիրելի՛ քաղաքացիներ,

Սահմանադրությունը պետք է լինի ժողովրդի՝ պետության և իշխանության տերը լինելու արտահայտությունը, դա պետք է արտահայտվի ոչ միայն տեքստով, այլև ծագումնաբանությամբ և իրականությամբ։ 2018 թվականի Ժողովրդական, ոչ բռնի, թավշյա հեղափոխությունից ի վեր ժողովուրդը պետության և իշխանության տերն է, և այս փաստը վերահաստատվեց 2026 թվականի հերթական խորհրդարանական ընտրություններում։ Սա նշանակում է, որ սահմանադրական ոգին Հայաստանի Հանրապետությունում ուժեղ է և հաստատուն, իսկ սահմանադիրը՝ ժողովուրդը, անսասան՝ ազատ և երջանիկ պետություն կառուցելու իր ձգտումների մեջ։
