Միջնորդագիր է ներկայացվել Սևանի ափամերձ հողամասի կառուցապատման իրավունքը դադարեցնելու վերաբերյալ

Գլխավոր դատախազության պետական շահերի պաշտպանության վարչությունը միջնորդագիր է ներկայացրել «Սևան» ազգային պարկ» ՊՈԱԿ-ի (այսուհետ՝ ՊՈԱԿ) տնօրենին և Շրջակա միջավայրի նախարարության գլխավոր քարտուղարին՝ 2008 թվականի հուլիսի 9-ին ՊՈԱԿ-ի և Խոսրով Ավետիսյանի միջև կնքված՝ Սևանա լճի ափամերձ՝ 3400 քմ մակերեսով հողամասի կառուցապատման իրավունքը դադարեցնելու ուղղությամբ միջոցներ ձեռնարկելու վերաբերյալ: Այս մասին տեղեկանում ենք Դատախազությունից։
Գլխավոր դատախազության պետական շահերի պաշտպանության վարչությունը, պետական (համայնքային) շահերի պաշտպանության հայց հարուցելու լիազորության շրջանակում, ուսումնասիրել է ՊՈԱԿ-ի և Խոսրով Ավետիսյանի միջև կնքված կառուցապատման պայմանագիրը և վերաբերելի փաստաթղթերը: Ուսումնասիրության արդյունքում պարզվել է, որ վարձակալության պայմանագրի գործողության ժամկետը սահմանված է եղել մինչև 2011 թվականի ապրիլի 8-ը, սակայն, ըստ Կադաստրի կոմիտեի կողմից տրված տեղեկանքի, պայմանագրից ծագող կառուցապատման իրավունքի դադարեցման վերաբերյալ տվյալներ առկա չեն:
Վերոշարադրյալի հիման վրա, ինչպես նաև հաշվի առնելով այն հանգամանքը, որ պայմանագրով սահմանված դրույթների համաձայն՝ պայմանագրով սահմանված ժամկետի ավարտից հետո, առանց սեփականատիրոջը նախօրոք ծանուցելու հողամասի տիրապետումն ու օգտագործումը կառուցապատողի կողմից չդադարեցնելը հիմք չէ պայմանագրի նորոգման կամ ժամկետի երկարաձգման համար՝ ՊՈԱԿ-ին միջնորդագիր է հասցեագրվել՝ կառուցապատման իրավունքի պետական գրանցումը դադարեցնելու ուղղությամբ միջոցներ ձեռնարկելու վերաբերյալ:
