«Փաստ» օրաթերթը գրում է.

Հայաստանում քաղաքական այլախոհությունը լռեցնելու և պետության ապագայով մտահոգ ուժերին չեզոքացնելու գործելաոճը վաղուց դուրս է եկել իրավական տարրական տրամաբանության սահմաններից։ Այս շղթայում առանձնահատուկ տեղ են զբաղեցնում «ՀայաՔվե» ազգային քաղաքացիական միավորման համակարգող, ներկայում քաղաքական շարժառիթներով կալանավորված հասարակական-քաղաքական գործիչ Ավետիք Չալաբյանի նկատմամբ իրականացվող հետապնդումն ու նրան կալանավորելու որոշումը, որն ուղեկցվեց օրենքի և ընթացակարգերի ակնհայտ ու կոպտագույն խախտումներով։ Իշխանությունները, փաստացի, գնացին աննախադեպ ապօրինությունների միայն այն պատճառով, որ օր առաջ մեկուսացնեն երկրում ընթացող կործանարար գործընթացների դեմ բարձրաձայնող գործչին։

Իրավական տեսանկյունից այս գործը կարելի է համարել ներկայիս դատաիրավական համակարգի ամոթալի էջերից մեկը, քանի որ մեղադրանքի հիմքում դրվեցին կասկածելի ու մանիպուլ յատիվ ձայնագրություններ, իսկ կալանքը կիրառվեց որպես պատժիչ գործիք, այլ ոչ թե խափանման միջոց։ Պետական ողջ մեքենան գործի դրվեց մեկ նպատակով՝ կոտրել դիմադրության օջախները և հանրությանը ցույց տալ, որ ցանկացած ինքնուրույն ու ազդեցիկ քննադատություն պատժվելու է անխնա կերպով։

Հատկանշական է, որ ներքին լսարանում այս գործընթացը «կոծկելու» և որպես սովորական քրեական իրավախախտում ներկայացնելու իշխանական ջանքերը լիովին տապալվեցին միջազգային հարթակներում։

Չալաբյանի նկատմամբ իրականացվող ակնհայտ քաղաքական հետապնդումը դարձել է միջազգային լուրջ քննարկումների առարկա և արդեն հասել է Եվրոպական խորհրդարան։ Մասնավորապես, Եվրոպական խորհրդարանի «Հայրենասերները Եվրոպայի համար» խմբակցության պատգամավոր Գերոլֆ Անեմանսը գրավոր հարցով, առաջնահերթության կարգով դիմել է Եվրոպական հանձնաժողովին՝ Հայաստանում ժողովրդավարության, իրավունքի գերակայության և քաղաքական ընդդիմախոսների նկատմամբ վերաբերմունքի վրա ուշադրություն հրավիրելու նպատակով։ Եվրապատգամավորը հիշեցրել է, որ դեռևս 2022 թվականին Ավետիք Չալաբյանի նկատմամբ իրականացված դատական վարույթները միջազգային մի շարք կազմակերպությունների կողմից արժանացել էին քննադատության՝ հիմնարար իրավունքների և արդար դատաքննության երաշխիքների պահպանման տեսանկյունից։ Ավելին, եվրոպացի պատգամավորի կողմից ուղղակի հարցադրում է արվել, թե արդյո՞ք Եվրոպական հանձնաժողովի նախագահ Ուրսուլա ֆոն դեր Լայենի՝ Երևան կատարած այցի ընթացքում քննարկվել է Ավետիք Չալաբյանի վերջին կալանավորման հարցը, և ինչպե՞ս է կառույցը գնահատում այս գործը՝ ԵՄ-Հայաստան հարաբերությունների համատեքստում ստանձնած ժողովրդավարական հանձնառությունների լույսի ներքո։

Իրավական կամայականությունների այս շքերթը միայն մեկ բան է ապացուցում. իշխող համակարգը գտնվում է խորը վախերի մեջ և սեփական անվտանգությունն ու աթոռը պահելու համար պատրաստ է ոտնահարել Սահմանադրությունն ու ժողովրդավարության մասին բոլոր հռչակված սկզբունքները։ Ավետիք Չալաբյանի դեմ սանձազերծված այս արշավը ոչ թե արդարադատության իրականացում է, այլ քաղաքական վրեժխնդրություն, որն էլ ավելի է խորացնում երկրում առկա ճգնաժամը և վերջնականապես արժեզրկում իրավական պետության գաղափարը։
