Հայաստանի գործող իշխանությունների նախաձեռնած՝ «Հայաստանի էլեկտրական ցանցեր» ընկերությունը հանրային գերակա շահ ճանաչելու գործընթացը շարունակում է բուռն քննարկումների առիթ տալ։ Մասնավորապես, գործընթացի շրջանակում անցկացված շուրջ 14 րոպե տևած հանրային լսումները քննադատության առիթ են դարձել՝ ընդդիմախոսների կողմից գնահատվելով որպես ձևական ընթացակարգ, որը, նրանց համոզմամբ, չի ապահովել հանրային քննարկման անհրաժեշտ մակարդակը։

Քննադատները հիշեցնում են, որ տարիներ առաջ, երբ գործարար և բարերար Սամվել Կարապետյանին պատկանող «Տաշիր» խումբը ձեռք բերեց ՀԷՑ-ը, ընկերությունը գտնվում էր ծանր տեխնիկական և ֆինանսական վիճակում։ Նրանց գնահատմամբ՝ հետագա տարիներին իրականացված բազմամիլիարդանոց ներդրումների, ենթակառուցվածքների արդիականացման և կառավարման բարեփոխումների շնորհիվ հնարավոր եղավ էապես բարձրացնել էլեկտրաբաշխիչ ցանցի արդյունավետությունն ու հուսալիությունը։

Այս ֆոնին իշխանությունների ներկայիս նախաձեռնությունը գնահատվում է որպես մասնավոր սեփականության նկատմամբ միջամտություն, որը, ըստ գործընթացի քննադատների, չունի բավարար իրավական և տնտեսական հիմնավորում։ Նրանք պնդում են, որ սեփականատիրոջը ներկայացված առաջարկները չեն արտացոլում ընկերության իրական արժեքը և կարող են բացասական ազդակ դառնալ ներդրումային միջավայրի համար։

Նրանց կարծիքով՝ եթե պետությունը կարող է քաղաքական կամ այլ պատճառներով միջամտել արդեն կայացած և խոշոր մասնավոր ներդրումային նախագծերին, ապա դա կարող է բացասաբար անդրադառնալ Հայաստանի ներդրումային հեղինակության վրա և մեծացնել իրավական պաշտպանության վերաբերյալ մտահոգությունները։

Միաժամանակ ՀԷՑ-ի սեփականատերերի ներկայացուցիչները բազմիցս հայտարարել են, որ պատրաստվում են օրենքով սահմանված բոլոր հնարավոր միջոցներով պաշտպանել իրենց իրավունքները՝ ինչպես Հայաստանի ներպետական, այնպես էլ միջազգային իրավական ատյաններում։ Նրանց համոզմամբ՝ վեճը պետք է լուծվի բացառապես իրավական ճանապարհով՝ ապահովելով սեփականության իրավունքի լիարժեք պաշտպանությունը։
