Զինծառայության անցնելու պայմանները կփոխվեն․ ինչ նոր հնարավորություն է նախատեսվում

«Պաշտպան հայրենյաց» ծրագրով պայմանագրային զինվորական ծառայության անցնել ցանկացող պարտադիր ժամկետային զինծառայողների համար առաջարկվում է ընդլայնել պայմանագիր կնքելու հնարավորությունները։

 

 

Iravaban.net–ն ուսումնասիրել է ՀՀ կառավարության 2023 թվականի փետրվարի 9-ի N 160-Ն որոշման մեջ լրացում կատարելու մասին նախագիծն ու դրան կից հիմնավորումը։

 

Նախագծով առաջարկվում է պայմանագրային զինվորական ծառայության անցնելու համար սահմանված պայմանը համապատասխանեցնել «Զինվորական ծառայության և զինծառայողի կարգավիճակի մասին» օրենքին։

 

Ի՞նչ է նախատեսում գործող կարգավորումը

 

Կառավարության N 160-Ն որոշման 1-ին հավելվածի 5-րդ կետի 3-րդ ենթակետով սահմանված է, որ պարտադիր զինծառայողի հետ պայմանագրային զինվորական ծառայության անցնելու պայմանագիր կարող է կնքվել, եթե նա ունի նշանակման ենթակա զինվորական պաշտոնին համապատասխանող զինվորական հաշվառման մասնագիտություն։

 

Սակայն գործող ձևակերպմամբ հաշվի չի առնվում զինվորական պաշտոնի հիմնական մասնագիտությանը հարակից մասնագիտություն ունենալու հնարավորությունը։

 

Ի՞նչ խնդիր է արձանագրել Պաշտպանության նախարարությունը

 

Նախագծի հիմնավորման համաձայն՝ «Զինվորական ծառայության և զինծառայողի կարգավիճակի մասին» օրենքի 35-րդ հոդվածի 1-ին մասով պայմանագրային զինծառայողը նշանակվում է իր հիմնական կամ հարակից զինվորական մասնագիտությանը համապատասխանող զինվորական պաշտոնի՝ հաշվի առնելով նաև ծառայողական գործունեության փորձը։

 

Նույն հոդվածի 5-րդ մասի համաձայն՝ զինվորական պաշտոններին համապատասխանող ռազմահաշվառային մասնագիտությունների ցանկը սահմանում է պետական լիազոր մարմնի ղեկավարը։

 

 

Հետևաբար, գործող կառավարության որոշմամբ նախատեսված պայմանն ավելի սահմանափակ է, քան օրենքով սահմանված հնարավորությունը։

 

Հիմնավորման մեջ որպես օրինակ նշվում է, որ գնդացրորդի հիմնական մասնագիտությանը հարակից է հրաձիգի մասնագիտությունը։

 

Ի՞նչ է փոխվելու

 

Նախագծով առաջարկվում է Կառավարության N 160-Ն որոշման 1-ին հավելվածի 5-րդ կետի 3-րդ ենթակետում «համապատասխանող» բառից հետո լրացնել «հիմնական կամ հարակից» բառերը։

 

Այսպիսով, պայմանագրային զինվորական ծառայության անցնելու պայմանագիր կնքելու համար զինծառայողը կարող է ունենալ տվյալ զինվորական պաշտոնին համապատասխանող ինչպես հիմնական, այնպես էլ հարակից ռազմահաշվառային մասնագիտություն։

 

Ո՞րն է փոփոխության նպատակը

 

Ըստ նախագծի հիմնավորման՝ փոփոխության նպատակն է վերացնել գործող կարգավորման և օրենքի միջև առկա անհամապատասխանությունը, ինչպես նաև հեշտացնել «Պաշտպան հայրենյաց» ծրագրով պայմանագրային զինվորական ծառայության կազմակերպման գործընթացը։

 

Նախագծի հեղինակների գնահատմամբ՝ գործող սահմանափակումը որոշակիորեն ազդում է պայմանագիր կնքելու վերաբերյալ ներկայացված դիմումների հետագա ընթացքավորման վրա։

 

Նախագծի ընդունմամբ լրացուցիչ ֆինանսական միջոցների ներգրավման և պետական բյուջեում փոփոխություններ կատարելու անհրաժեշտություն չի առաջանա։

 

Նախատեսվում է, որ որոշումն ուժի մեջ կմտնի պաշտոնական հրապարակմանը հաջորդող օրվանից»,-տեղեկացնում է կայքը։
