Գերիշխող դիրքի չարաշահման համար «Կոկա Կոլա»-ն տուգանվեց 50 միլիոն դրամով

ՀՀ տնտեսական մրցակցության պաշտպանության պետական հանձնաժողովի փետրվարի 26-ի նիստում հրապարակվեցին «Կոկա Կոլա» ընկերության հանդեպ հարուցված վարչական վարույթի արդյունքները:Գերիշխող դիրքի չարաշահման համար ընկերության հանդեպ կիրառվեց 50 միլիոն դրամ տուգանք: Վարույթը հարուցվել է «Ջերմուկ Ինթերնեյշնլ Պեպսի-Կոլա Բոթլեր» ընկերության բողոքի հիման վրա: Մասնավորապես, «Ջերմուկ Ինթերնեյշնլ Պեպսի-Կոլա Բոթլեր» ընկերությունը դիմում-բողոք է ներկայացրել հանձնաժողով, տեղեկացնելով, որ «Դալմա Գարդեն Մոլ» զվարճաառևտրային համալիրի սննդի սպասարկման տարածքում գործունեություն իրականացնող 11 տնտեսվարողները հրաժարվում են ձեռք բերել և իրենց հաճախորդներին վաճառել «Պեպսի կոլա» ըմպելիքը: Իր արտադրանքի իրացման նպատակով բոլոր բանա կցությունները մնացել են անարձագանք: Մինչդեռ նշյալ բոլոր օբյեկտներում լայնորեն ներկայացված են «Կոկա Կոլա» ընկերության ըմպելիքները:
Հանձնաժողովի կողմից իրականացված ուսումնասիրությունների արդյունքում պարզ է դարձել, որ տնտեսավարողների ներկայացրած պատճառաբանություններն ու հիմնավորումները, թե ինչու չեն վաճառում «Պեպսի կոլա» ըմպելիքը, արժանահավատ չեն: ՏՄՊՊՀ-ն բացահայտել է, որ «Կոկա Կոլա» ՓԲԸ-ն որոշակի շահավետ պայմաններ է առաջարկում տնտեսավարղներին` միայն իր արտադրանքն իրացնելու պայմանով: Այս եզրակացությանը եկել են ուսումնասիրության շրջանակները «Դալմա Գարդեն Մոլ»-ի տարածքից դուրս տարածելով` ընդգրկելով տասնյակ այլ օբյեկտներ: Պարզվել է, որ զեղչերի , ակցիաների կամ այլ շահավետ պայմանների միջոցով «Կոկա Կոլա»-ն պարտադրում է, որ տասնյակ օբյեկտներ իրացնեն միայն իր արտադրանքը: Ընկերության ֆիրմային սառնարանները անհատույց տրամադրվում են տնտեսվարողներին` արգելելով իր սառնարաններում այլ ըմպելիքների ներկայացումը, այլապես խիստ միջոցներ կկիրառեն:
Հանձնաժողովի ուսումնասիրությունները պարզել են, որ «Կոկա Կոլա»-ն տասնյակ տնտեսավարողների մարքետինգային ծախսերի անվան տակ խոշոր չափերի գումար են փոխանցել` վահանակները, ցուցանակները և այլ պարագաները ցուցադրելու համար: «Կոկա Կոլա» ընկերությունը խիստ տարբերակված մոտեցում է ցուցաբերել նաև զեղչային քաղաքականություն իրականացնելիս:
ՏՄՊՊՀ-ն համարում է, որ նման վարքագծի պատճառով «Կոկա Կոլա»-ի և մրցակից ընկերությունների միջև ստեղծվում են անհավասար մրցակցային պայմաններ:
