Գնդապետը զինվորական ծառայությունից ազատելու դիմաց չորս հազար դոլար է պահանջել

Երեւանի Ավան եւ Նոր-Նորք վարչական շրջանների ընհանուր իրավասության դատարանում Նոր-Նորքի նախկին զինվորական կոմիսար Ռաֆայել Զախարյանի կողմից կաշառք վերցնելու փաստով հարուցվել է քրեական գործ: Այս մասին տեղեկանում ենք Դատական տեղեկատվական համակարգից:

Գնդապետ Ռաֆայել Զախարյանին մեղադրանք է առաջադրվել այն բանի համար, որ նա, զբաղեցնելով տեղական զորակոչային հանձնաժողովի նախագահի պաշտոնը, 2014թ. մարտի 17-ին իր աշխատասենյակում Երևան քաղաքի բնակիչ Գագիկ Վարդանյանից պահանջել է չորս հազար ամերիկյան դոլար՝ որդուն զինվորական ծառայությունից ազատելու դիմաց:

Մասնավորապես, ըստ Դատական տեղեկատվական համակարգի՝ Զախարյանը Գագիկ Վարդանյանի որդու՝ Ալբերտ Վարդանյանի օգտին առողջական վիճակի բերումով պահեստազորում հաշվառելու, դրանով իսկ զինվորական ծառայության զորակոչից վերջնականապես ազատելու դիմաց պահանջել է 1 միլիոն 659 հազար 840 դրամին համարժեք 4 հազար ամերիկյան դոլար կաշառք: Մի քանի օր անց էլ Զախարյանը զինկոմիսարիատի զորակոչային բաժանմունքի պետի աշխատասենյակում Գագիկ Վարդանյանից ստացել է 3 հազար 900 ԱՄՆ դոլար: Սրանից բացի՝ գնդապետ Զախարյանը ապօրինի կերպով ձեռք է բերել ռազմամթերք հանդիսացող «ՊՄ» և «ԱՊՍ» ատրճանակների համար նախատեսված, գործարանային արտադրության 9 միլիմետր տրամաչափի 24 հատ փամփուշտ և դրանք պահել իրեն պատկանող «Տոյոտա Պրադո» մակնիշի ավտոմեքենայի պահախցիկում:

Ռաֆայել Զախարյանին մեղադրանք էր առաջադրվել ՀՀ քրեական օրենսգրքի 311 հոդվածի չորրոդ մասի երկրորդ կետով եւ 235 հոդվածի առաջին մասով: Նա դատապարտվել էր 3 տարի 6 ամիս ժամկետով ազատազրկման` միաժամանակ զրկվելով երկու տարի ժամկետով որոշակի պաշտոններ զբաղեցնելու իրավունքից: Գնդապետը ձերբակալվել էր եւ պատժի կրման սկիզբ էր հաշվարկվել 2014թ. մարտի 19-ը:

Որոշ ժամանակ անց մեղադրող կողմը բողոքարկել էր դատավճիռը՝ առաջարկելով բեկանել նախնական դատավճիռը եվ պատիժն ավելի խստացնել՝ դատապարտելով Զախարյանին 9 տարվա ազատազրկման:

Գործը քրեական վերաքննիչ դատարան էր տեղափոխվել Քննչական կոմիտեի Զինվորական քննչական գլխավոր վարչության ՀԿԳ քննության վարչությունում քննվող գործերի բաժնի դատախազ Լեւոն Պետրոսյանի վերաքննիչ բողոքի հիման վրա: Բողոքը մասնակիորեն բավարարվել էր՝ նախկին դատավճիռը բեկանվել, և գործն ուղարկվել էր նույն դատարան` այլ կազմով նոր քննություն կատարելու նպատակով: Ռաֆայել Զախարյանի նկատմամբ որպես խափանման միջոց կիրառված կալանավորումը շարունակում է մնալ անփոփոխ:

Ծանուցում. Հանցագործության մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
