Ո՞ւմ շահերից է բխում նոր Ընտրական օրենսգիրքը, ո՞վ էր այն թաքցնում

«Թրանսփարենսի Ինթերնեշնլ հակակոռուպցիոն կենտրոն» հասարակական կազմակերպությունն իր մտահոգությունն է հայտնում նոր ընտրական օրենսգրքի նախագծի մշակման եւ ՀՀ կառավարության առաջիկա նիստի օրակարգ ներկայացնելու գործընթացի անօրինականության վերաբերյալ: Նոր Սահմանադրությամբ ուղղակիորեն նախատեսվում է, որ ընտրական օրենսգիրքը պետք է համապատասխանեցվի Սահմանադրությանը մինչեւ 2016 թվականի հունիսի 1-ը: Ընտրական օրենսգրքի մշակմանը եւ ներկայացմանը մասնակցող պատասխանատու մարմիններ են սահմանվել Արդարադատության նախարարությունը եւ Կենտրոնական ընտրական հանձնաժողովը, իսկ ԱԺ-ի քննարկմանը ներկայացնելու վերջնաժամկետը՝ 2016թ. մարտի 1-ը: Սահմանված ժամկետում, սակայն, օրինագիծը չի ներկայացվել եւ չի հրապարակվել, իսկ պատասխանատու պետական մարմինները գաղտնի են պահել օրինագծի պատրաստ լինելու փաստը:

Ինչպես տեղեկանում ենք «Թրանսփարենսի Ինթերնեշնլ հակակոռուպցիոն կենտրոն»-ի տարածած հաղորդագրությունից, ի պատասխան «Իրազեկ քաղաքացիների միավորում» ՀԿ-ի հարցման՝ ՀՀ արդարադատության նախարարությունը 2016 թվականի փետրվարի 23-ի պատասխան-գրությամբ տեղեկացրել է, որ Ընտրական օրենսգրքի նախագիծը գտնվում է մշակման փուլում եւ աշխատանքներն ավարտելուն պես կդրվի հանրային քննարկման ու հասանելի կլինի կայքում: Մինչդեռ, դրա նախորդ օրը՝ փետրվարի 22-ին, Եվրոպայի խորհրդի «Ժողովրդավարություն՝ իրավունքի միջոցով» եվրոպական հանձնաժողովի (Վենետիկի հանձնաժողով) պաշտոնական կայքում արդեն տեղադրված է եղել Ընտրական օրենսգրքի նախագծի անգլերեն տարբերակը: Միաժամանակ, նախագծի մշակման համար պատասխանատու կառույցներն ու պաշտոնյաները խուսափել են մասնակցել փետրվարի 29-ին «Գործընկերություն հանուն բաց հասարակության» նախաձեռնության կազմակերպած քննարկմանն ու տեղեկացնել օրենսգրքի նախագծի մշակման ընթացքի մասին:

Ընտրական օրենսգրքի նախագիծը հանրությանը հասանելի է դարձել միայն մարտի 2-ին՝ կառավարության նիստի օրակարգի շրջանակում՝ որտեղ ակնկալվում է հավանություն տալ նախագծին ու ներկայացնել Ազգային ժողով: Սակայն կառավարության նիստի օրակարգում նախագիծն ընդգրկվելու պահի դրությամբ անգամ այն հասանելի չի եղել ո´չ Արդարադատության նախարարության եւ ո´չ էլ ԿԸՀ կայքերում: Նախագծի հեղինակները, այսինքն` իշխանությունը, խախտել են օրենքով սահմանված ընթացակարգերն ու հանրության տեղեկացված լինելու իրավունքը՝ չհրապարակելով նախագիծը, խուսափելով հանրային քննարկումներից, ինչի պատճառով հանրությունը որեւէ տեղեկություն չի ունեցել Ընտրական օրենսգրքի նախագծի մշակման կամ այն մշակող աշխատանքային խմբի վերաբերյալ:

«Թրանսփարենսի»-ն հայտարարության միջոցով իր դժգոհությունն ու բողոքն է հայտնում Ընտրական օրենսգրքի նախագիծը մշակող աշխատանքային խմբի գործելաոճի նկատմամբ եւ պահանջում է ապահովել սահմանված ընթացակարգերի պահպանումն ու հանրային քննարկումները:
