Թովմա Մաթևոսյանի սպանության գործով Վանաձորի դատարանի վճիռը բեկանվել է, գործն ուղարկվել է նոր քննության

Վերաքննիչ դատարանը (դատավորներ՝ Մ. Պապոյան, Վ. Ռշտունի, Կ. Ղազարյան), Թովմա Մաթևոսյանի սպանության գործով ամբաստանյալ Տիգրան Մելիքյանի և նրա շահերի պաշտպաններ Տիգրան Աթանեսյանի, Արա Զաքարյանի և Գուրգեն Հարությունյանի վերաքննիչ բողոքը բավարարել է, բեկանել է Լոռու մարզի ընդհանուր իրավասության առաջին ատյանի դատարանի (դատավոր Աղասի Մկոյան) կայացրած դատավճիռը և քրեական գործն ուղարկել է նույն դատարան՝ այլ կազմով նոր քննության:
Վերաքննիչ դատարանն արձանագրել է, որ սույն քրեական գործով ոտնահարվել է ամբաստանյալ Տիգրան Մելիքյանի պաշտպանության իրավունքը: Այսպես, պաշտպան Տիգրան Աթանեսյանը դատական նիստի ժամանակ հայտնել է դատավոր Մկոյանին, որ չի կարող նշանակված օրը մասնակցել դատական քննությանը, բայց դատավորը նիստը հենց այդ օրն է նշանակել՝ ժամը 11:00-ին, որին պաշտպան Աթանեսյանը չի ներկայացել, դատավորը նիստը հետաձգել և նշանակել է նույն օրը՝ ժամը 16:00-ին, իսկ դատական նիստի ժամի մասին պաշտպանին տեղեկացնելու պարտականությունը դրել է ամբաստանյալի վրա, որից հետո կրկին պաշտպան Աթանեսյանի բացակայության պատճառաբանությամբ դատական նիստը հետաձգել և նշանակել մեկ շաբաթ հետո, որի վերաբերյալ էլ պաշտպան Աթանեսյանը ներկայացրել է դիմում` հայտնելով, որ այդ ընթացքում գտնվելու է հերթական արձակուրդում, սակայն դատավորը, հաշվի չառնելով նշված հանգամանքը, հայտարարել է, որ պաշտպան Աթանեսյանը 3-4 անգամ անհարգելի չի ներկայացել դատական նիստերին և որոշել է հեռացնել նրան վարույթից` պաշտպանությունը դնելով ամբաստանյալ Մելիքյանի վրա:
Դատական նիստին ամբաստանյալ Մելիքյանը հայտնել է, որ ցանկանում է ցուցմունք տալ հաջորդ դատական նիստին` իր պաշտպանի ներկայությամբ, սակայն դատավոր Մկոյանը, անտեսելով նրա իրավունքը, արձանագրել է, թե ամբաստանյալը հրաժարվում է ցուցմունք տալ և որոշել է հրապարակել նրա նախաքննական ցուցմունքները, որից հետո դատաքննությունը հայտարարել է ավարտված և անցել դատական վիճաբանությունների փուլին: Դատական նիստին ներկայացել է պաշտպան Արա Զաքարյանը, իսկ նույն օրը դատավորի՝ խորհրդակցական սենյակից վերադառնալուց հետո նա ներկա չի գտնվել դատական նիստին, ինչի պատճառով նիստը հետաձգվել է, դրան հաջորդող երկու նիստերի օրերի ու ժամերի մասին պաշտպան Զաքարյանը պատշաճ ծանուցված չի եղել, սակայն դատավոր Մկոյանը, հաշվի չառնելով դա, և այն, որ ամբաստանյալը ցանկանում է պաշտպան ունենալ, որոշել է գործի վարույթից հեռացնել Զաքարյանին և ավարտել դատական քննությունը:
Վերաքննիչ դատարանն արձանագրել է, որ առաջին ատյանի դատարանը շտապողականության արդյունքում չի ապահովել ամբաստանյալ Մելիքյանի պաշտպանության իրավունքը, թույլ է տվել քրեադատավարական օրենքի էական խախտում, որն էլ իր հերթին հանգեցրել է արդար դատաքննության սկզբունքի խախտմանը: Իսկ պաշտպանության իրավունքն արդարադատության իրականացման կարևորագույն բաղադրիչն է. դրա ցանկացած խախտում, ի վերջո, անխուսափելիորեն հանգեցնում է արդարադատության բուն էության խեղաթյուրմանը:
Վերաքննիչ դատարանը միաժամանակ հարկ է համարել նշել, որ պաշտպանության իրավունքի խախտումն սկսվելուց հետո է ամբաստանյալը զրկվել ցուցմունք տալու իրավունքից, ուստի դատաքննության ընթացքում անհրաժեշտ է հարցաքննել ամբաստանյալին, քննության առարկա դարձնել կողմերի, այդ թվում` պաշտպանների և ամբաստանյալի միջնորդությունները, որից հետո նոր հայտարարել դատաքննության ավարտը:
