Գեղարքունիքում 45-ամյա տղամարդը մի հողակտորի պատճառով բռունցքներով ծեծել է իր հորը

Գեղարքունիքի մարզի ընդհանուր իրավասության դատարանում Վարդան Հարությունյանի նախագահությամբ ավարտվել է Մանվել Ս.-ի գործի դատական քննությունը:
45-ամյա Մանվելը մեղադրվել է տուժողի առողջությանը դիտավորությամբ թեթև վնաս հասցնելու համար՝ ՀՀ քրեական օրենսգրքի 117 հոդվածով:
Տուժողը Մանվելի հարազատ հայրն է…
Ըստ մեղադրանքի՝Մանվելը 2015 թվականի հոկտեմբերի 22-ին, ժամը 13-ի սահմաններում հոր անասնագոմի մոտ վիճել է նրա հետ, դիտավորյալ հարվածներ է հասցրել հորը՝ պատճառելով ստորին ծնոտի, աջ վերին և ստորին կոպերի շրջանների արյունազեղումների, ստորին կոպի ենթամաշկի արյունահավաքի, ձախ դաստակի թիկնային մակերեսի քերծվածքների ձևով վնասվածքներ:
Առաջադրված մեղադրանքում Մանվելն իրեն մեղավոր չի ճանաչել:
Տուժողը՝ Մանվելի հայրը, հայտնել է, թե ամբաստանյալ Մանվելն իր հարազատ որդին է, նրա հետ վատ հարաբերությունների մեջ է:
2010 թվականի օգոստոսին Մանվելը գյուղապետի միջնորդությամբ դարձել է իր հետ համատեղ սեփականության իրավունքի տեր:
Այդ ժամանակ էլ նա իրենց դուրս է արել ոստիկանների միջոցով:
Հոլանդիա մեկնող իրենց համագյուղացուն իրենք խնդրել են, որ նա իր տան նկուղային հարկը ժամանակավորապես տրամադրի իր յոթ հոգանոց ընտանիքին:
Այդ նկուղում իրենք ապրել են մինչև 2015 թվականի ապրիլի 7-ը:
Դրանից հետո իրենք ապրում են դրսում:
Մանվելը սեփականության իրավունքով ամբողջ իրենց ունեցվածքը վերցրել է իր ձեռքը:
Տուժողը հայտնել է, թե անասնագոմը գնել է ինքը, Մանվելը գոմի հետ ոչ մի կապ չունի: Մանվելը դեռ 1993 թվականից ունի սեփականաշնորհած հողատարածք ու հանդիսացել է առանձին ընտանիք:
Դեպքի օրն իր կինը տեսել է, որ իրենց «Կախովի կրիշ» կոչվող անասնագոմի «հրապարակը» վարում են:
Ինքը կնոջ ձայնը լսել, մոտեցել ու տեսել է, որ տրակտորը վարել է իր գոմի «հրապարակը»: Ինքը տրակտորիստին չի ճանաչել, վերջինս իրենց մոտենալուց հետո հեռացել է:
Մանվելն իրեն ու կնոջն ասել է, որ թողնեն-հեռանան, քանի որ այդտեղ ոչ մի բան չունեն: Նա հարվածել է իրեն…
Մայրը Մանվելին մի կողմ է քաշել, չի թողել, որ իրեն խփի: Այդ ժամանակ ինքը գնացել է ոստիկանություն ու հաղորդում է տվել:
Իր որդին անտեղի է իրեն հարվածել…
Տուժողի կինը՝ ամբաստանյալ Մանվելի մայրը, ասել է, թե հոր աչքին հարվածելով՝ որդին ասել է՝ աչքերդ կհանեմ…
Ըստ այս վկայի՝ տեսնելով, որ տրակտորը վարում է իրենց գոմի դիմացի հողատարածքը, ինքը մոտեցել է տրակտորիստին ու հարցրել է, թե ինչո՞ւ է վարում այդ հողը, իրենք անասուններին գոմից ո՞նց են հանելու:
Տրակտորիստն ասել է, թե Մանվելի ասելով է հողը վարում: Նա թողել-հեռացել է: Իսկ հողամասում կանգնած Մանվելն ասել է, թե դա իր հողն է, իր սեփականությունն է…
Վիճաբանության ժամանակ որդին մի քանի անգամ բռունցքով հարվածել է հորը, վերջինս ընկել է գետնին: Ինքը որդուն մի կողմ է տարել, իսկ ամուսինը գնացել է ոստիկանություն:
Մանվելը պնդել է, թե ինքը հորը չի ծեծել…
Մանվելն իր հերթին երեք երեխաների հայր է…
Ընդհանուր իրավասության դատարանը Մանվել Ս.-ին մեղավոր է ճանաչել հորը ծեծելու, նրա առողջությանը թեթև վնաս պատճառելու համար ու դատապարտել է տուգանքի՝ 100 հազար դրամի չափով:
