Հարկադիր կատարողը պաշտոնեական անփութություն է կատարել

ՀՀ արդարադատության նախարարության ԴԱՀԿ ծառայության Կոտայքի մարզային բաժնի հարկադիր կատարողը, դրսևորելով անփույթ վերաբերմունք իր ծառայության նկատմամբ և ոչ պատշաճ կատարելով իր պարտականությունները, Յուրի Մ.-ից տեղեկացված լինելով Կենտրոն և Նորք-Մարաշ վարչական շրջանների ընդհանուր իրավասության դատարանի կողմից լրացված կատարողական թերթի կրկնակի նմուշի կեղծված լինելու մասին, հարուցել է կատարողական վարույթ, որի հետևանքով Յուրի Մ.-ի շահերին անզգուշությամբ պատճառվել է էական վնաս՝ խախտվել է սահմանադրությամբ նախատեսված նրա գույքի նկատմամբ սեփականության իրավունքը:
Դեպքի առթիվ ՀՀ քննչական կոմիտեի Կոտայքի մարզային քննչական վարչությունում ՀՀ քրեական օրենսգրքի 315-րդ հոդվածի 1-ին մասի հատկանիշներով հարուցվել է քրեական գործ և ըստ քննչական ենթակայության քննության ուղարկվել ՀՀ հատուկ քննչական ծառայություն:

Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով' դատարանի' օրինական ուժի մեջ մտած դատավճռով:
