Սահմանադրական «ապդեյթ» օրենսդրական դաշտում

Անի Սանոսյանը ֆեյսբուքյան իր էջում գրում է.
2015թ. դեկտեմբերի 6-ի հանրաքվեով ընդունված ՀՀ սահմանադրության փոփոխությունների 16-րդ գլխում կոնկրետ ժամկետների մատնանշմամբ հստակ պահանջ է սահմանված օրենսդրական դաշտը համապատասխանեցնել Հիմնական օրենքի փոփոխություններին:
Մասնավորապես, 210-րդ հոդվածով նախատեսված են Ընտրական օրենսգրքի, Ազգային ժողովի կանոնակարգի, Կուսակցությունների մասին սահմանադրական օրենքի, Մարդու իրավունքների պաշտպանի մասին սահմանադրական օրենքի, Տեղական ինքնակառավարման մասին օրենքի փոփոխությունները, Դատախազության, Հեռուստատեսության և ռադիոյի, Հաշվեքննիչ պալատի և Կենտրոնական բանկի մասին օրենքները Սահմանադրությանը համապատասխանեցնելու և ուժի մեջ մտնելու ժամկետները: Նույն հոդվածի 3-րդ մասի համաձայն այլ սահմանադրական օրենքները համապատասխանեցվում են Սահմանադրությանը և ուժի մեջ են մտնում նորընտիր ՀՀ նախագահի՝ իր պաշտոնն ստանձնելու օրը:
ՀՀ նախագահի 2016թ. փետրվարի 10-ի հրամանագրով հաստատվել է Սահմանադրության փոփոխություններով անվանականորեն սահմանված և ընդունման, փոփոխման կամ լրացման ենթակա օրենքների ցանկը: Նույն հրամանագրի 5-րդ կետի 2-րդ ենթակետի հիման վրա անհրաժեշտ էր հաստատել Սահմանադրության փոփոխությունների՝ օրենքով կարգավորման պահանջ ուղղակիորեն նախատեսող դրույթների հիման վրա ընդունման, փոփոխման կամ լրացման ենթակա օրենքների ցանկը, ինչը և արեց ՀՀ կառավարությունն իր ս.թ. մարտի 10-ի նիստում:
Ինչպես հայտնի է, այժմ Ազգային ժողովում քննարկվող Ընտրական նոր օրենսգրքի նախագծի ընդունման վերջնաժամկետը ս.թ. հունիսի 1-ն է:
Մինչև ս.թ. ապրիլի 3-րդ տասնօրյակ ՀՀ կառավարություն պետք է ներկայացվեն Քաղաքական ապաստանի մասին և Փաստաբանության մասին օրենքներում փոփոխություններ կատարելու օրինագծերը, մինչև մայիսի 3-րդ տասնօրյակ՝ Քաղաքացիության մասին օրենքի փոփոխությունների նախագիծը, մինչև հունիսի 1-ին տասնօրյակ՝ Անհատական և կոլեկտիվ հանրագրերի մասին օրենքի նախագիծը և այլն: Այս ցուցակի վերջին՝ 63-րդ նախագիծը՝ Հանրային ծառայության մասին օրենքի փոփոխությունը, կառավարություն ներկայացնելու ժամկետ է սահմանվել 2017թ. դեկտեմբերի 1-ին տասնօրյակը:
Այսպիսով, համակարգվում և մեկ միասնական ցանկով ամբողջացվում են բոլոր այն օրենքները, որոնք բխում են ՀՀ սահմանադրության փոփոխությունների՝ օրենքով կարգավորման պահանջ ուղղակիորեն նախատեսող դրույթներից՝ դրանով իսկ ապահովելով Հիմնական օրենքով նախատեսված համալիր լուծումների ներառումը ՀՀ օրենսդրություն:
