Կալանավորի նկատմամբ բռնություն են գործադրել

Կալանավայրում գտնվող քաղաքացին տվյալներ է հաղորդել ՀՀ ոստիկանության Մաշտոցի բաժնի աշխատակիցների կողմից իր նկատմամբ բռնություն գործադրելու վերաբերյալ:
ՀՀ հատուկ քննչական բաժանմունքի լրատվական ծառայության հաղորդած տեղեկատվության համաձայն՝ ՀՀ ոստիկանության Մաշտոցի բաժնի ծառայող Ա. Թ.-ն 2016թ. փետրվարի 16-ին ծառայություն իրականացնելիս նկատել է փողոցում աղմկող եւ հայհոյանքներ հնչեցնող մի քաղաքացու, մոտեցել եւ պահանջել դադարեցնել հասարակական կարգի խախտումը, սակայն վերջինս չի ենթարկվել ոստիկանի օրինական պահանջին:
Ոստիկանի կանչով դեպքի վայր են ժամանել ոստիկանության այլ աշխատակիցներ՝ քաղաքացուն ոստիկանության Մաշտոցի բաժին բերման ենթարկելու նպատակով: Այստեղ նա շարունակել է չենթարկվել ոստիկանների օրինական պահանջներին, բռունցքով հարվածներ է հասցրել ոստիկանության ծառայողին, կոտրել է հերթապահ մասի խցի դուռը:
Դեպքի առթիվ ՀՀ քննչական կոմիտեի Աջափնյակ եւ Դավթաշեն վարչական շրջանների քննչական բաժնում հարուցված քրեական գործով` քաղաքացի Կամո Հ.-ին մեղադրանք է առաջադրվել իշխանության ներկայացուցչի նկատմամբ բռնություն գործադրելու եւ խուլիգանություն կատարելու համար եւ նրա նկատմամբ որպես խափանման միջոց է ընտրվել կալանավորումը: Այնուհետև «Նուբարաշեն» քրեակատարողական հիմնարկի կալանավոր Կամո Հ.-ն, նախազգուշացված լինելով սուտ մատնություն կատարելու համար նախատեսված քրեական պատասխանատվության մասին, հայտնել է ՀՀ ոստիկանության Մաշտոցի բաժնի աշխատակիցների կողմից առերևույթ բռնության գործադրմամբ զուգորդված պաշտոնեական լիազորություններն անցնելու վերաբերյալ տվյալներ:
Հատուկ քննչական ծառայությունում ՀՀ քրեական օրենսգրքի 309-րդ հոդվածի 2-րդ մասի հատկանիշներով հարուցվել է քրեական գործ «Նուբարաշեն» քրեակատարողական հիմնարկի կալանավոր Կամո Հ.-ի հաղորդման հիման վրա՝ ՀՀ ոստիկանության Մաշտոցի բաժնի աշխատակիցների կողմից բռնության գործադրմամբ զուգորդված պաշտոնեական լիազորություններն անցնելու դեպքի առթիվ:
Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
