Տանտերը պարտքով գումար խնդրող հյուրի նկատմամբ կիրառել է բռնություն

ՀՀ քննչական կոմիտեի Երևան քաղաքի քննչական վարչության Աջափնյակ և Դավթաշեն վարչական շրջանների քննչական բաժնում ավարտվել է քաղաքացուն՝ Ն.Մկրտչյանին, ծանր մարմնական վնաս պատճառելու դեպքի առթիվ հարուցված քրեական գործի նախաքննությունը:
Ինչպես «Արմենպրես»-ին տեղեկացրին ՀՀ քննչական կոմիտեի դեպարտամենտի տեղեկատվության և հասարակայնության հետ կապերի բաժնից, քրեական գործի նախաքննությամբ պարզվել է, որ տուժողը և առերևույթ հանցագործություն կատարած անձը նախկինում գտնվել են լավ հարաբերությունների մեջ և հաճախակի այցելել միմյանց։ Դեպքի օրը՝ 2015 թվականի մայիսի 30-ին, ժամը 20:00-ի սահմաններում, գործով տուժողը գնացել է իր ծանոթ Դ.Հովհաննիսյանի տուն՝ գումար խնդրելու։ Գումարային հարցի շուրջ առաջացել է վիճաբանություն, որի ժամանակ տանտերը հյուրի նկատմամբ կիրառել է բռնություն՝ ձեռքերով և ոտքերով բազմաթիվ հարվածներ հասցրել հյուրի գլխին և մարմնի տարբեր հատվածներին՝ պատճառելով մարմնական վնասվածքներ և դուրս հանել տանից։
Դատաբժշկական փորձաքննության եզրակացության համաձայն՝ տուժողին պատճառվել է կյանքին վտանգ սպառնացող ծանր մարմնական վնաս՝ գլխի, դեմքի շրջանների քերծվածքների, արյունազեղումների, սալջարդ վերքերի, գանգի հիմի կոտրվածքի, քթի ոսկրերի և հայմորյան ծոցի առաջային պատի կոտրվածքների, ենթաոստայնային արյունազեղման, գլխուղեղի միջին աստիճանի սալջարդի, իրանի, վերին և ստորին վերջույթների շրջանների քերծվածքների, արյունազեղումների, առաջին գոտկային ողի կոտրվածքի ձևով:
Ձեռք բերված ապացույցների համակցությամբ՝ Դ.Հովհաննիսյանին մեղադրանք է առաջադրվել՝ ՀՀ քրեական օրենսգրքի 112-րդ հոդվածի 1-ին մասով (դիտավորությամբ առողջությանը ծանր վնաս պատճառելը):
Քրեական գործը՝ մեղադրական եզրակացությամբ, ուղարկվել է նախաքննության օրինականության նկատմամբ հսկողություն իրականացնող դատախազին: Մեղադրական եզրակացությունը հաստատվել է, և գործն ուղարկվել դատարան:
Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցվածչէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
