Հայաստանի իշխանությունների ներկայացրած Ընտրական օրենսգրքի նոր նախագծում առկա են լրագրողների իրավունքներին ու մասնագիտական գործունեությանը վերաբերող դրույթներ ու ձևակերպումներ, որոնք հակասում են ՀՀ Սահմանադրությանը, ԶԼՄ-ների մասին ՀՀ օրենքին, ՀՀ Քրեական օրենսգրքին, մի շարք այլ իրավական, այդ թվում՝ միջազգային փաստաթղթերին։

Այսպես, նախագծի 65-րդ հոդվածի 7-րդ կետը ենթադրում է տեղական դիտորդների ու լրագրողների՝ ընտրատեղամասերում միաժամանակ գտնվելու թվային սահմանափակում և այդ սահմանափակումից բխող հերթագրման ընթացակարգ, ինչպես նաև ընտրական հանձնաժողովի նախագահին և ոստիկանությանը որոշակի իրավասությունների տրամադրում։

Նախագծի 20-րդ հոդվածի 13-րդ կետի համաձայն՝ նախընտրական քարոզարշավի իրականացման ընթացքում չի թույլատրվում զանգվածային լրատվական միջոցների ազատության չարաշահումը։ Վերոնշյալ երկու կետերի ձևակերպումների ու բովանդակության վերաբերյալ հրապարակային իրենց մտահոգությունն են հայտնել ինչպես լրագրողներ, այնպես էլ իրավապաշտպան կազմակերպություններ, կուսակցություններ, անհատ քաղաքացիներ և այլ միավորներ։

Մենք՝ ներքոնշյալ հասարակական կազմակերպությունների ներկայացուցիչներս, անընդունելի ենք համարում ՀՀ և միջազգային օրենսդրությանն ակնհայտորեն չհամապատասխանող այս դրույթների ներառումն Ընտրական օրենսգրքում ու օրինագիծը հեղինակած իշխանությունից պահանջում ենք հեռացնել դրանք և ընտրական օրենսգրքի նախագծում չավելացնել լրագրողների իրավունքներին ու մասնագիտական գործունեությանը վերաբերող և իրավունքին հակասող այլ էկզոտիկ նորարարություններ։

Համարում ենք, որ մեր այս պահանջի վերաբերյալ իշխանության ներկայացուցիչների հետ բանակցությունները, երկխոսությունը, քննարկումներն իմաստազուրկ են, քանի որ պահանջը ձևակերպված է հստակ, ունի իրավական հիմնավորում, և իշխանությունն ընդամենը պետք է հրաժարվի իր հակաիրավական մոտեցումներից, ինչի համար անհրաժեշտ են ոչ թե իմիտացիոն հանդիպումներ, այլ իշխանության կամք։

Ընդգծում ենք, որ հետևողական ենք լինելու մեր այս պահանջում և օգտագործելու ենք իրավունքով չարգելված բոլոր միջոցները՝ պահանջի ի կատար ածմանը հասնելու նպատակով։ Շեշտում ենք, որ լրագրողների իրավունքներին ու մասնագիտական գործունեությանը վերաբերվող հարցերը ոչ միայն լրագրողների, այլ ողջ հանրության խնդիրն են, ուստի քաղաքացիական հասարակության ներկայացուցիչներին, քաղաքական, հասարակական միավորներին, քաղաքացիներին, միջազգային ու տեղական իրավապաշտպան կազմակերպություններին կոչ ենք անում հետևողականորեն սատար կանգնել այս պահանջին և չեզոքացնել ժողովրդավարությանը, ազատ խոսքին սպառնացող այս վտանգը։
