Փաստաբանն էլ փաստաբանի կարիք կունենա

Փաստաբան Նարինե Մկրտչյանը իր ստորագրությունը կեղծելու մեջ մեղադրել էր ավագ քննիչ Արտյոմ Շոխոյանին, սակայն պարզվել է, որ ինքն անձամբ է ստորագրել այդ փաստաթուղթը:

Մասնավորապես, ինչպես հայտնում են Հատուկ քննչական ծառայության լրատվական ծառայությունից՝ ՀՔԾ-ում քննվող քրեական գործի նախաքննության ընթացքում հիմնավորվել է, որ ՀՀ փաստաբանների պալատի փաստաբան Նարինե Մկրտչյանը հանցագործության կատարման մեջ անհիմն մեղադրել է ՀՀ քննչական կոմիտեի Երեւան քաղաքի քննչական վարչության Մալաթիա-Սեբաստիա վարչական շրջանի քննչական բաժնի ավագ քննիչ Արտյոմ Շոխոյանին:

Այսպես, Հատուկ քննչական ծառայությունը փետրվարի 15-ին հաղորդագրություն էր տարածել, որ  փաստաբան Նարինե Մկրտչյանը հաղորդում էր տվել այն մասին, որ իր պաշտպանյալի վերաբերյալ քննվող քրեական գործի դատաքննության ընթացքում ծանոթացել է քրեական գործի նյութերին եւ տեղեկացել, որ գործի նյութերին կցվել են քննիչ Արտյոմ Շոխոյանի կողմից կազմված արձանագրություններ: Ուսումնասիրելով դրանք՝ փաստաբանը պարզել է, որ նախաքննության ավարտման մասին հայտնելու արձանագրությունում առկա են իր ստորագրությանը նման ստորագրություն եւ ազգանվան ու անվան սկզբնատառի մասին գրառումներ: Մինչդեռ հիշյալ արձանագրության տակ ինքը չի ստորագրել, իր ազգանվան վերաբերյալ գրառումը եւ արձանագրության մեջ դրված ստորագրությունը կեղծված է:

Նարինե Մկրտչյանի հաղորդման հիման վրա Հատուկ քննչական ծառայությունում Քրեական օրենսգրքի 314-րդ հոդվածի առաջին մասով հարուցված քրեական գործի նախաքննության ընթացքում պատշաճ ընթացակարգով ստուգվել են փաստաբանի մատնանշած՝ ավագ քննիչի կողմից առերեւույթ պաշտոնեական կեղծիք կատարելու դրվագների բոլոր հանգամանքները: Միաժամանակ նշանակվել էին դատաձեռագրաբանական եւ փաստաթղթաբանական համալիր փորձաքննություններ:

Արդյունքում պարզվել է, որ արձանագրության տակ առկա ձեռագիր գրառումները և ստորագրությունները կատարվել են անձամբ փաստաբանի կողմից:

Այսինքն` Նարինե Մկրտչյանը գիտակցելով իր տրամադրած տեղեկատվության կեղծ լինելը՝ հանցագործության կատարման մեջ անհիմն մեղադրել է ավագ քննիչ Արտյոմ Շոխոյանին:

Փաստաբանին մեղադրանք է առաջադրվել Քրեական օրենսգրքի 333-րդ հոդվածի առաջին մասով: Նշենք, որ ըստ Քրեական օրենսգրքի՝ վերոհիշյալ հոդվածը սահմանում է պատիժ տուգանքի տեսքով՝ նվազագույն աշխատավարձի երկուհարյուրապատիկից չորսհարյուրապատիկի չափով, կամ ուղղիչ աշխատանքներ՝ մեկից երկու տարի ժամկետով, կամ կալանք՝ մեկից երեք ամիս ժամկետով, կամ էլ ազատազրկում՝ առավելագույնը երկու տարի ժամկետով:

Հավելենք նաեւ, որ այս գործը մեղադրական եզրակացությամբ հանձնվել է դատավարական հսկողություն իրականացնող դատախազին՝ այն հաստատելու եւ դատարան ուղարկելու նպատակով:

Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
