«Ազատության» լրագրողի աշխատանքը խոչընդոտելու վերաբերյալ քրգործն ուղարկվել է դատարան

Քաղաքացի Նշան Ասատրյանին մեղադրանք է առաջադրվել «Ազատություն» ռադիոկայանի լրագրող Անուշ Մկրտչյանի լիազորությունների իրականացմանը խոչընդոտելու համար:
Ըստ Հատուկ քննչական ծառայության տրամադրած տեղեկատվության՝ քրեական գործի նախաքննությամբ հիմնավորվել է, որ Նշան Ասատրյանը ուղղակի դիտավորությամբ խոչընդոտել է Սահմանադրության փոփոխությունների հանրաքվեի ընթացքը լուսաբանող՝ «Ազատություն» ռադիոկայանի լրագրող Անուշ Մկրտչյանի լիազորությունների իրականացմանը:
Մասնավորապես՝ Սահմանադրության փոփոխությունների հանրաքվեի օրը՝ 2015 թվականի դեկտեմբերի վեցին, լրագրող Անուշ Մկրտչյանը Կոմիտասի 56 հասցեում գործող «Այո» ընտրական քարոզչական շտաբի դիմաց տեղի ունեցող իրադարձությունները լուսաբանելու նպատակով տեսախցիկով նկարահանում է կատարել: Այդ տեսնելով` Նշան Ասատրյանը մոտեցել է լրագրողին եւ պահանջել դադարեցնել նկարահանումներն ու հեռանալ: Անուշ Մկրտչյանը, սակայն, շարունակել է նկարահանումը, ինչին ի պատասխան, Նշան Ասատրյանը ձեռքով բռնել է տեսախցիկի օբյեկտիվը եւ նրանից պահանջել տեսախցիկը կամ դրա հիշողության քարտը հանձնել իրեն:
Այս կերպ՝ Նշան Ասատրյանը իր դիտավորյալ գործողություններով խանգարել է նկարահանման իրականացմանը՝ խոչընդոտելով զանգվածային լրատվության միջոցի ներկայացուցչի լիազորությունների իրականացմանը: Նշան Ասատրյանին հանցագործություն կատարելու համար մեղադրանք է առաջադրվել Քրեական օրենսգրքի 149-րդ հոդվածի առաջին մասով:
Նշենք, որ ըստ Քրեական օրենսգրքի վերոնշյալ հոդվածի՝ զանգվածային լրատվության միջոցի ներկայացուցչի լիազորությունների իրականացմանը խոչընդոտելը պատժվում է տուգանքով՝ նվազագույն աշխատավարձի երկուհարյուրապատիկից չորսհարյուրապատիկի չափով, կամ կալանքով՝ առավելագույնը մեկ ամիս ժամկետով:
Հատուկ քննչական ծառայությունում արդեն իսկ ավարտվել է քրեական գործի նախաքննությունը եւ այն մեղադրական եզրակացությամբ հանձնվել է դատավարական հսկողություն իրականացնող դատախազին՝ այն հաստատելու եւ դատարան ուղարկելու նպատակով:
Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
