Ինչո՞ւ է մեկ տասնյակ վարկառու դատի տվել «ՎՏԲ բանկ»-ին

Մոտ երկու տարի առաջ «Հետքը» գրել էր, որ Ադրբեջանի պետական նավթային ֆոնդը «ՎՏԲ-Հայաստան բանկ» ՓԲԸ-ի 100% բաժնետեր «ՎՏԲ Բանկ» ԲԲԸ-ի 2.95% բաժնետոմսերը ձեռք է բերել 2013թ. մայիսին: Այս բացահայտումը, սակայն, 2014-ին մեծ աղմուկ չհանեց հասարակական և քաղաքական լայն շրջանակներում, սակայն երկու տարի անց այդ բացահայտումը տվեց իր հետևանքները։
Բանն այն է, որ մոտ մեկ տասնյակ քաղաքացիներ 2016 թվականին դիմել են առաջին ատյանի դատարաններ` «ՎՏԲ Հայաստան բանկի» հետ կնքած վարկային պայմանագրերն անվավեր ճանաչելու պահանջով: Հայցվորներն իրենց պահանջը հիմնավորել են ՀՀ Քաղաքացիական օրենսգրքի 432 հոդվածով, որում ամրագրված է՝ Հոդված 432. Պարտավորության դադարելը կատարման անհնարինությամբ։
1. Պարտավորությունը դադարում է կատարման անհնարինությամբ, եթե դա առաջացել է այնպիսի հանգամանքից, որի համար կողմերից որևէ մեկը պատասխանատու չէ: Այդ դեպքում պարտատերն իրավունք չունի պարտապանից պահանջել պարտավորության կատարում:
2. Պարտապանի կողմից պարտավորության կատարման անհնարինության դեպքում, որն առաջացել է պարտատիրոջ մեղքով, պարտատերն իրավունք չունի հետ պահանջել պարտավորությամբ իր կատարածը: Հայցվորները գտնում են, որ այն հանգամանքը , որ 2013-ին Ադրբեջանի Հանրապետությունը դարձել է «ՎՏԲ Հայաստան բանկի» փաստացի սեփականատերերից մեկը, անհնարին է դարձնում իրենց կողմից վարկերի սպասարկումը, քանի որ, սպասարկելով վարկերը, իրենք ակամայից ֆինանսական օգնություն են ցույց տալիս թշնամական պետությանը, որն էլ իր հերթին կարող է հանգեցնել քրեական պատասխանատվության:
Հայցվորները վստահեցրել են, որ քանի որ «ՎՏԲ Բանկն» ինքն է վաճառել իր բաժնեմասը Ադրբեջանի Հանրապետությանը, ապա տվյալ իրավիճակի ողջ պատասխանատվությունը պետք է կրի բանկը և վարկառուներից վարկի գումարները պահանջելու իրավունք չունի:
