Դրամաշնորհային ծրագրերն առանց ԱԱՀ-ի

ՀՀ օրենսդրության համաձայն 2013թ. հունվարի 1-ից պետբյուջեից տրամադրվող դրամաշնորհը դիտարկվում է որպես ԱԱՀ-ով հարկվող օբյեկտ՝ եթե դրա դիմաց գումար ստացողն ունենում է ապրանք մատակարարելու կամ ծառայություն մատուցելու պարտավորություն: Նկատի առնելով այն հանգամանքը,որ պետբյուջեից կամ միջազգային կազմակերպությունից ստացված դրամաշնորհը ստացող կազմակերպությանը տրվում է համապատասխան պայմանագրի հիման վրա, որով ստացողն ստանձնում է զանազան պարտավորություններ՝ դրամաշնորհով իրականացվող ծրագիրն հարկվում է ԱԱՀ-ով և արդյունքում վտանգվում է դրա լիարժեք իրականացումը:
Միաժամանակ վտանգվում է ոչ միայն ՀՀ տնտեսության զարգացման համար չափազանց կարևոր նշանակության ծրագրերի իրականացումը, այլև դժվարանում է տարբեր ոլորտներում նոր վերազգային կազմակերպությունների ներգրավումը Հայաստան և վերջիններիս հետ համատեղ տարբեր ոլորտների զարգացմանն ուղղված հեռանկարային ծրագրերի իրականացումը: Այս հարցը բազմիցս արծարծվել է ՏՏ ոլորտին վերաբերող տարբեր քննարկումների, այդ թվում՝ ՏՏ զարգացմանն աջակցող խորհրդի նիստերի ընթացքում:
Հաշվի առնելով այս իրողությունը և պետբյուջեից ու միջազգային կազմակերպություններից ստացված դրամաշնորհների նպատակային ուղղվածությունը, ՀՀ էկոնոմիկայի նախարարությունն առաջարկում է «Ավելացված հարկի մասին» ՀՀ օրենքում կատարել հետևյալ լրացումը. «Սուբսիդիայի, սուբվենցիայի և դրամաշնորհային ծրագրի շրջանակներում իրականացվող գործարքներն ազատվում են ԱԱՀ-ից՝եթե նշված ծրագրերն արժանացել են ՀՀ կառավարության ձևավորած մասնագիտական հանձնաժողովի դրական եզրակացությանը»:
Օրենքի նշված փոփոխության առաջարկը ներառված է ՀՀ կառավարության առաջիկա մարտի 31-ի նիստի օրակարգ և ուղղված է հեռանկարային (այդ թվում ՝ վերազգային կազմակերպությունների հետ համատեղ իրականացվող) ծրագրերի շարունակականության ապահովմանն ու նոր նախաձեռնությունների կատարմանը:
Կառավարության հավանությունն ստանալու դեպքում օրինագիծը սահմանված կարգով կներկայացվի ՀՀ Ազգային ժողով: Նախագծի ընդունմամբ կվերանա օրենքի վերը նշված հոդվածի տարընթերցումը և չի վտանգվի ՀՀ տնտեսության զարգացման համար կարևոր նշանակություն ունեցող ծրագրերի իրականացումը:
