«Ընտրությունների մասին» օրենքն «Իշխանության փոփոխության» մասին օրենք պետք է լինի. Ազատ Արշակյան

Ըստ Գերագույն խորհրդի նախկին պատգամավոր Ազատ Արշակյանի՝ նոր Ընտրական օրենսգրքի գաղափարախոսությունը ճիշտ չէ: Past.am-ի հետ զրույցում նա ասաց, որ «Ընտրությունների մասին» օրենքն «Իշխանության փոփոխության» մասին օրենք պետք է լինի: Նրա համոզմամբ՝ հարկավոր է հաշվի առնել նախորդ ընտրությունների ժամանակ արձանագրված թերությունները:

«Ես կարծում եմ՝ այս Ընտրական օրենսգիքն ընտրությունների մասին չէ, այսինքն՝ իշխանափոխության մասին չէ, այն իշխանության վերարտադրության մասին է: Այն դեպքում, երբ ժողովրդավարական երկրում այսպիսի օրենք չի կարող քննարկվել և ընդունվել»,- ասաց քաղաքական գործիչը:

Պարոն Արշակյանը շատ լուրջ դիտողություններ ունի: «Նախ՝ այդ օրենքը միայնակ չպետք է գար: Այն պետք է ուղեկցվեր «Կուսակցությունների մասին» օրենքում և քրեական օրենսգրքում նախատեսվելիք փոփոխություններով, այսինքն՝ փաթեթով լիներ: Պետք է լինեին քրեական հոդվածներ՝ ընտրակեղծարարության, պաշտոնյաների կողմից ռեսուրսների օգտագործման և այլ հանցանքների դեպքում խիստ պատիժների վերաբերյալ: Չընտրված մարդիկ չեն կարող հայտնվել իշխանության մեջ, ընտրված մարդիկ պետք է հայտնվեն: Քրեական օրենսգիրքը պետք է լուրջ պատիժներ սահմանի կաշառքի, «կարուսելի», լցոնումների, տեղամասերում անկարգությունների համար: Հայտնաբերողները պաշտոնյաները պետք է լինեն, իսկ լրագրողները, դիտորդներն վստահված անձինք՝ հետևեն անվտանգությունն ու թափանցիկությունը ապահովող պաշտոնյաների գործունեությունը: Ընտրությունների բնականոն ընթացքը պետք է ապահովեն ոստիկանությունը, ԱԱԾ-ն, քննչական մարմինները: Իսկ «Կուսակցությունների մասին» օրենքում պետք է անպայման ֆիքսվի, որ կուսակցությունները հավասար մեկնարկային հնարավորություն ունեն:

Այսինքն՝ ընտրություններին մասնակցող կուսակցությունները պետք է բոլոր բնակավայրերում ունենան գրանցված մասնաճյուղեր, որպեսզի հասարակությունն ու արդարադատության նախարարությունն իմանան, որ գրանցված կազմակերպություն կա այդ բնակավայրում: Պարտադիր պետք է լինի լուրջ դեկլարացիա՝ ֆինանսական, տնտեսական, նյութական ունեցվածքի մասին և այն մասին, ինչպես է ձևավորվում կուսակցության ունեցվածքը: Դա պետք է լինի հարկայինի կողմից ստուգված և հաստատված: Մարդը չի կարող կուսակցությանը նվիրատվություն, անդամավճար, միջոցներ տրամադրել ավելի շատ, քան միջին աշխատավարձի տասնապատիկն է»:

Անդրադառնալով ընդդիմության մասնակցությամբ «4+4+4» քննարկումների ձևաչափին՝ պարոն Արշակյանը ողջունեց նախաձեռնությունը: Նրա կարծիքով՝ անհրաժեշտ է մասնակցել բոլոր տեսակի օրենսդրական նախաձեռնություններին, քանի որ քաղաքական կուսակցությունների և հասարակական կազմակերպությունների առաքելությունը հենց դրանում է:

«Բոյկոտն ընդունում եմ միայն այն դեպքում, երբ բոյկոտը ձախողում է այդ օրենքի ընթացքը: Հաղթելու շանս ունեցողը կարող է բոյկոտ անել: Եթե հաղթելու շանս չունեցողը բոյկոտ է անում, ապա նա խուսափում է քննարկումներից: Ես կոչ եմ անում քննարկումներին մասնակցել»,- իր խոսքը եզրափակեց Ազատ Արշակյանը:
