Դատական ակտը դիտավորությամբ չկատարելու փաստի առթիվ հարուցվել է քրեական գործ

Քաղաքացի Սամվել Հ.-ն, նախազգուշացված լինելով սուտ մատնություն կատարելու համար նախատեսված քրեական պատասխանատվության մասին, հայտնել է ՀՀ արդարադատության նախարարության դատական ակտերի հարկադիր կատարումն ապահովող ծառայության Աբովյանի բաժանմունքի հարկադիր կատարողի կողմից առերևույթ դատական ակտը դիտավորությամբ չկատարելու վերաբերյալ տվյալներ: Այս մասին «Արմենպրես»-ին տեղեկացրին ՀՀ հատուկ քննչական ծառայության լրատվական ծառայությունից:
Մասնավորապես՝ Սամվել Հ.-ն հաղորդում է տվել այն մասին, որ ՀՀ վերաքննիչ քաղաքացիական դատարանի 2015 թվականի մարտի 4-ի որոշմամբ բավարարվել է իր և որդու վերաքննիչ բողոքը` քաղաքացի Ռուզաննա Ս.-ից 9 հազ. ԱՄՆ դոլար բռնագանձելու պահանջի մասին:
2015 թվականի օգոստոսի 5-ին տրված կատարողական թերթի համաձայն՝ վճիռը 2015 թվականի հունիսի 10-ին ստացել է օրինական ուժ և նույն թվականի օգոստոսի 11-ին ՀՀ արդարադատության նախարարության դատական ակտերի հարկադիր կատարումն ապահովող ծառայության Աբովյանի բաժանմունքում կասեցված վարույթը վերսկսվել է, սակայն հիշյալ բաժանմունքի հարկադիր կատարողը դիտավորությամբ չի կատարել օրինական ուժի մեջ մտած դատական ակտը և արգելանքի տակ դրված գույքից բռնագանձում չի կատարել:
ՀՀ արդարադատության նախարարության դատական ակտերի հարկադիր կատարումն ապահովող ծառայության Աբովյանի բաժանմունքի հարկադիր կատարողի կողմից դատական ակտը դիտավորությամբ չկատարելու դեպքի առթիվ ՀՀ հատուկ քննչական ծառայությունում ՀՀ քրեական օրենսգրքի 353-րդ հոդվածի 1-ին մասի հատկանիշներով հարուցվել է քրեական գործ:
Կատարվում է նախաքննություն:
Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
