ԼՂՀ գլխավոր դատախազը քրեական գործ է հարուցել ագրեսիվ պատերազմի հոդվածով

 ԼՂՀ գլխավոր դատախազ  Արթուր Մոսիյանն  ապրիլի 4-ին անցկացրել է օպերատիվ  խորհրդակցություն հանրապետության իրավապահ կառույցների պատասխանատուների մասնակցությամբ` քննարկելու 2016թ. ապրիլի 2-ի գիշերը  ադրբեջանական զինված ուժերի կողմից ռազմական գործողությունների և դրանց արդյունքների  փաստերով արդեն իսկ հարուցված քրեական գործերով իրականացված նախաքննության արդյունքները:

Արցախի դատախազության պաշտոնական կայքի հաղորդագրությունում նշված է. «Նկատի ունենալով, որ հարուցված քրեական գործերով  պարզվել է, որ Ադրբեջանի Հանրապետության զինված ուժերը, խախտելով ղարաբաղա-ադրբեջանական հակամարտության շրջանակներում 1994թ. մայիսի 12-ին ուժի մեջ մտած` Լեռնային Ղարաբաղի Հանրապետության,Ադրբեջանի Հանրապետության և Հայաստանի  Հանրապետության պաշտպանության նախարարների կողմից ստորագրած հրադադարի մաս ին համաձայնագրի պայմանները, 2016թ. ապրիլի 2-ի գիշերը ցամաքային զորքերի, օդուժի, հրթիռա-հրետանային միջոցների և զրահատեխնիկայի  կիրառմամբ ագրեսիայի ակտ են իրականացրել ԼՂՀ-ի դեմ` խախտելով համաձայնագրի կողմ  հանդիսացող Լեռնային Ղարաբաղի Հանրապետության տարածքային  ամբողջականությունը:

Միաժամանակ, ագրեսիվ պատերազմ վարելու ընթացքում Ադրբեջանի Հանրապետության  զինված ուժերը ռազմական գերազանցության հասնելու նպատակով, կոպտորեն խախտելով  միջազգային իրավունքի նորմերը, պատերազմ վարելու արգելված միջոցների և  մեթոդների կիրառմամբ, միջազգային մարդասիրական իրավունքի նորմերի լուրջ  խախտմամբ, ոչ ընտրովի հարձակման օբյեկտներ են դարձրել խորը թիկունքում  գտնվող  խաղաղ  բնակավայրերը, քաղաքացիական բնակչությանը, օբյեկտները՝ դպրոցներ,  շինություններ, ճանապարհներ, այլ ենթակառույցներ  և առանձին քաղաքացիական անձանց,  ինչը առաջացրել է միջազգային իրավունքի պաշտպանության տակ գտնվող բազմաթիվ  անձանց մահ, այդ թվում` երեխաների, մեծ չափերի անօրինական, կամայական  գույքի ոչնչացում: Տվյալ փաստերով ԼՂՀ նախաքննություն իրականացնող մարմինների կողմից հարուցվել են քրեական գործեր:

Վերոգրյալը հիմք ընդունելով՝  ԼՂՀ գլխավոր դատախազը որոշում է կայացրել հարուցել քրեական գործ ԼՂՀ քրեական օրենսգրքի 410 (Ագրեսիվ պատերազմ) և 416 (Միջազգային մարդասիրական իրավունքի նորմերի լուրջ խախտումները զինված  ընդհարումների ժամանակ) հոդվածներով: Միաժամանակ, գլխավոր դատախազի հանձնարարությամբ ստեղծվել է քննչական խումբ` ԼՂՀ ոստիկանության քննչական  վարչության պետի գլխավորությամբ, և տվյալ գործով նախաքննությունը հանձնարարվել  է այդ քն նչական խմբին»:
