ՀՀ հատուկ քննչական ծառայությունում քննվող քրեական գործի նախաքննությամբ հիմնավորվել է, որ նախկինում մի քանի անգամ դատապարտված Երվանդ Թորոսյանը 2014թ. ընթացքում ծանոթացել է Գեղամ Գեղամյանի հետ, տեղեկացել, որ վերջինս օգտագործել է թմրամիջոց, նրան հայտնել է, որ ունի «Մարիխուանա» տեսակի թմրամիջոց եւ առաջարկել է ցանկության դեպքում գնել: Գեղամ Գեղամյանի մոտ թմրամիջոց ապօրինի ձեռք բերելու դիտավորություն առաջացնելուց հետո, Երվանդ Թորոսյանը նշել է, որ կարող է այն վաճառել մեկ գրամը 7 հազ. ՀՀ դրամով: Նշել է նաեւ, որ դրանք վաճառում է փաթեթներով, որոնցից յուրաքանչյուրի քաշը 0.7 գրամ է:

2014թ. օգոստոսի սկզբներին Ե. Թորոսյանը հանդիպել է Գ. Գեղամյանին: Վերջինս վճարել է 1 մլն. 400 հազ. ՀՀ դրամ եւ գնելու նպատակով Ե. Թորոսյանից ապօրինի ձեռք բերել 300 փաթեթներում փաթեթավորված  խոշոր չափի «Մարիխուանա» տեսակի թմրամիջոց:

Հետագայում Դավիթ Ապետնակյանը, տեղյակ լինելով, որ մորեղբայրը՝ Գեղամ Գեղամյանը, իր արհեստանոցում պահում է «Մարիխուանա» տեսակի թմրամիջոց, 2014թ. մայիս ամսից մինչեւ օգոստոս ամիսն ընկած ժամանակահատվածում նշված արհեստանոցից իր օգտագործման համար ապօրինի ձեռք է բերել մեկ փաթեթում փաթեթավորված զգալի չափի «Մարիխուանա» տեսակի թմրամիջոց` դրա դիմաց վճարելով 15 հազ. ՀՀ դրամ:

Բացի այդ, Դավիթ Ապետնակյանը ՀՀ ոստիկանության կրթահամալիրի սովորող Հակոբ Կիրակոսյանին ծանոթացրել է մորեղբոր` Գեղամ Գեղամյանի հետ, հայտնել, որ նա վաճառում է «Մարիխուանա» տեսակի թմրամիջոց: Դ. Ապետնակյանը տեղեկացրել է նաեւ, որ իր դասընկերներ Տիգրան Պողոսյանն ու Լեւոն Նազարյանը ցանկություն ունեն ձեռք բերել նշված թմրամիջոցից:

Հ. Կիրակոսյանը, ընկերոջ տրամադրած տեղեկություններն օգտագործելով, մեկ միասնական դիտավորությամբ, 2014թ. օգոստոսից մինչեւ նոյեմբեր ամիսներն ընկած ժամանակահատվածում ապօրինի իրացնելու նպատակով մեկ փաթեթը 10 հազ. ՀՀ դրամով ընդհանուր 210 փաթեթներում փաթեթավորված խոշոր չափի «Մարիխուանա» տեսակի թմրամիջոց է գնել Գեղամ Գեղամյանից եւ 1 փաթեթը 15 հազ. ՀՀ դրամով վերավաճառել Տիգրան Պողոսյանին (110 փաթեթ) ու Լեւոն Նազարյանին (100 փաթեթ):

ՀՀ հատուկ քննչական ծառայությունում քննվող քրեական գործի նախաքննության ընթացքում Երվանդ Թորոսյանին եւ Գեղամ Գեղամյանին մեղադրանք էր առաջադրվել ՀՀ քրեական օրենսգրքի 266-րդ հոդվածի 2-րդ մասի 2-րդ կետով, Դավիթ Ապետնակյանին՝ ՀՀ քրեական օրենսգրքի 38-266-րդ հոդվածի 2-րդ մասի 2-րդ կետով եւ 268-րդ հոդվածի 1-ին մասով, Հակոբ Կիրակոսյանին՝ ՀՀ քրեական օրենսգրքի 266-րդ հոդվածի 1-ին մասով եւ 266-րդ հոդվածի 2-րդ մասի 2-րդ կետով, իսկ Տիգրան Պողոսյանին ու Լեւոն Նազարյանին ՀՀ քրեական օրենսգրքի 268-րդ հոդվածի 2-րդ մասի 2-րդ կետով:

ՀՀ հատուկ քննչական ծառայությունում ավարտվել է խոշոր չափի թմրամիջոցն ապօրինի իրացնելու դեպքի առթիվ հարուցված քրեական գործի նախաքննությունը: Հիշյալ գործը մեղադրական եզրակացությամբ հանձնվել է դատավարական հսկողություն իրականացնող դատախազին՝ այն հաստատելու եւ դատարան ուղարկելու համար:
