Ավան և Նոր Նորք բաժնի դատական ակտերի հարկադիր կատարողներն անցել են պաշտոնեական լիազորությունները

 Քաղաքացի Անուշ Պ.-ն, նախազգուշացված լինելով սուտ մատնություն կատարելու համար նախատեսված քրեական պատասխանատվության մասին, հայտնել է ՀՀ արդարադատության նախարարության դատական ակտերի հարկադիր կատարումն ապահովող ծառայության (ԴԱՀԿ) Երևան քաղաքի Ավան և Նոր Նորք բաժնի հարկադիր կատարողների կողմից առերևույթ պաշտոնեական լիազորություններն անցնելու վերաբերյալ տվյալներ: Այս մասին «Արմենպրես»-ին տեղեկացրին ՀՀ հատուկ քննչական ծառայության լրատվական ծառայությունից:

Մասնավորապես՝ Անուշ Պ.-ն հաղորդում է տվել այն մասին, որ Երևան քաղաքի Ավան և Նոր Նորք վարչական շրջանների ընդհանուր իրավասության դատարանի կողմից տրված կատարողական թերթերի հիման վրա ԴԱՀԿ ծառայության Երևան քաղաքի Ավան և Նոր Նորք բաժնի հարկադիր կատարողի կողմից համապատասխանաբար 2015թ. սեպտեմբերի 17-ին և հոկտեմբերի 06-ին հարուցվել են կատարողական վարույթներ և արգելանք է դրվել իր գույքի և դրամական միջոցների, ինչպես նաև  սեփականության իրավունքով իրեն պատկանող՝ բնակարանում գտնվող գույքի վրա: Համապատասխան կատարողական գործողություններ կատարել ուց հետո, 2015թ նոյեմբերի 30-ին որոշում է կայացվել  կատարողական վարույթներն  ավարտելու մասին:

ԴԱՀԿ ծառայության Երևան քաղաքի Ավան և Նոր Նորք բաժնի աշխատակիցներն, առանց  կատարողական վարույթները վերսկսելու և առանց  իրեն ծանուցելու, դուրս գալով իրենց լիազորությունների շրջանակից, 2016թ. հունվարի 21-ին՝ ժամը 20:00-ի սահմաններում, այցելել են իր բնակարան, այնտեղ գտնվող հարևանից տեղեկանալով իր՝ բնակարանից բացակայության մասին, այնուհանդերձ, մտել են ներս և փորձել ապօրինի կատարողական գործողություններ կատարել, սակայն հարևանի պահանջով գործողություն չեն կատարել և արձանագրություն կազմելով՝ հեռացել են:

ՀՀ արդարադատության նախարարության դատական ակտերի հարկադիր կատարումն ապահովող ծառայության Երևան քաղաքի Ավան և Նոր Նորք բաժնի հարկադիր կատարողների կողմից առերևույթ պաշտոնեական լիազորություններն անցնելու դեպքի առթիվ ՀՀ հատուկ քննչական ծառայությունում ՀՀ քրեական օրենսգրքի 309-րդ հոդվածի 1-ին մասի հատկանիշներով հարուցվել է քրեական գործ:

Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
