Գյուղապետը 5 միլիոն դրամ կաշառք է պահանջել

Արարատի եւ Վայոց ձորի ընդհանուր իրավասության դատարանում քրեական գործ է հարուցվել Սիփանիկի գյուղապետի կողմից կաշառք ստանալու փաստի առթիվ:

Ըստ Դատական տեղեկատվական համակարգի՝ գյուղապետ Արայիկ Մանուկյանին մեղադրանք է առաջադրվել այն բանի համար, որ Գրետա Գևորգյանի օգտին որոշում կայացնելու համար նրանից պահանջել ու անձամբ ստացել է առանձնապես խոշոր չափերով կաշառք:

Մասանվորապես, զբաղեցնելով Արարատի մարզի Սիփանիկ համայնքի ղեկավարի պաշտոնը եւ հանդիսանալով պաշտոնատար անձ՝ ձեւականորեն կազմակերպվող աճուրդին համայնքի տարածքում գտնվող ինը հա գյուղատնտեսական նշանակության հողատարածքը Երեւան քաղաքի բնակչուհի Գրետա Գևորգյանին վաճառելու համար, նրանից պահանջել է հինգ միլիոն 500 հազար դրամ կաշառք: Այնուհետեւ 2014թ-ի նոյեմբերին գյուղապետարանում կազմակերպել է ձևական աճուրդ, որին մասնակցել են Գրետա Գևորգյանը եւ վերջինիս կողմից հրավիրված անձը:

Աճուրդում առաջարկված հողատարածքի վաճառքի առավելագույն գինը կազմել է մեկ միլիոն 632 հազար 500 դրամ դրամ, եւ Գրետա Գևորգյանը պատրաստակամություն է հայտնել մուծել միայն աճուրդով սահմանված վերոնշյալ գումարը, իսկ կաշառք տալուց հրաժարվել է: Սակայն գյուղապետ Արայիկ Մանուկյանն իր հերթին կայացված աճուրդը չեղյալ է հայտարարել:

Դրանից հետո, 2015թ-ի մարտին Գրետա Գևորգյանը կրկին դիմել է գյուղապետարան նշված ինը հա գյուղատնտեսական նշանակության հողատարածքը իրեն վաճառելու համար, որի դիմաց Արայիկ Մանուկյանն կրկին գումար է պահանջել: Արդեն 2015թ-ի ապրիլին գհուղապետն իր տանը Գ. Գեւորգյանից ստացել է հինգ միլիոն 200 հազար դրամ կաշառք եւ նույն պահին բռնվել ոստիկանության աշխատակիցների կողմից:
Բացի այդ, Գրետա Գևորգյանի մասնակցությամբ տեղի ունեցած աճուրդի անցկացման օրը` գյուղապետարանի շենքում վերջինից վերցրել է հարյուր հազար դրամ գումար` նրա եւ նրա հետ աճուրդին մասնակցած Թոռնիկ Միրզոյանի աճուրդի մասնակցության համար երեք հազարական դրամ գումարները եւ աճուրդի մեկնարկային գնի հինգ տոկոսը` 77 հազար դրամը գյուղապետարանի բյուջե մուծելու համար, սակայն մուծելու փոխարեն յուրացրել է:

Գյուղապետն այս պահին կալանավորված է եւ նրան մեղադրանք է առաջադրվել Քրեական օրենսգրքի 179-րդ հոդվածի երկրորդ մասի առաջին կետով եւ 311-րդ հոդվածի չորրորդ մասի երկրորդ կետով: Սրանցից առաջինը նախատեսում է տուգանք՝ նվազագույն աշխատավարձի չորսհարյուրապատիկից յոթհարյուրապատիկի չափով, կամ ազատազրկում՝ երկուսից չորս տարի ժամկետով, կամ որոշակի պաշտոններ զբաղեցնելու ու որոշակի գործունեությամբ զբաղվելու իրավունքից զրկում՝ առավելագույնը երեք տարի ժամկետով կամ առանց դրա: Իսկ երկրորդը՝ յոթից տասներկու տարի ժամկետով ազատազրկում, որն կարող է ուղեկցվել գույքի բռնագրավմամբ:

Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
