 Աշխատանքային իրավունքների խախտումներն առավել շատ նկատվում են մասնավոր հատվածում:

Այս մասին «Արմենպրես»-ի մամուլի սրահում հրավիրված ասուլիսում նշեց ՀՀ փաստաբաննների պալատի փաստաբան, հանրային պաշտպան Աշոտ Նուրիջանյանը:

«Մասնավոր սեկտորում աշխատանքային օրենսդրության խախտումները բազմաթիվ են, վիճակը շտկելու անհրաժեշտություն կա: Մասնավոր սեկտորում գործատուները փաստացի ավելի շատ լիազորություններ ունեն, քան պետականում: Խախտումներ արձանագրվում են հիմնականում փոքր և միջին  ձեռնարկատիրական գործունեություն իրականացող տնտեսավարողների շրջանում:  Հանդիպող խախտումներից է աշխատողներին չգրանցելը, այնինչ բոլոր աշխատողները պետք է գրանցված լինեն: Աշխատողների մի ստվար զանգված աշխատում է առանց գրանցման: Լինում են դեպքեր, երբ աշխատակազմը մասնակի է գրանցված»,-ասաց հանրային պաշտպանը:

Աշոտ Նուրիջանյանը նկատեց, որ, ցավոք, աշխատողները նորմալ են վերաբերվում այդ երևույթին, մինչդեռ հենց աշխատողները պետք է ձեռնամուխ լինեն և պարտավորեցնեն գործատուին, որ իրենց հետ կնքվի աշխատանքային պայմանագիր: Հանրային պաշտպանը տեղեկացրեց, որ աշխատանքային պայմանագիր չկնքելն արդեն հանգեցնում է օրենսդրական մի շարք դրույթների  խախտմանը: Աշխատողը չի կարողանում օգտվել օրենքով սահմանված իրավունքներից` կապված արձակուրդի, հավելյալ աշխատաժամանակի համար վճարվելու և այլ հարցերի հետ:

Գործատուների հանրապետական միության նախագահի տեղակալ Շուշանիկ Բարսեղյանը նշեց, որ աշխատողները չեն տիրապետում իրենց իրավունքներին, պարտավորություններին: Եթե չեն տիրապետում, ապա չեն կարող հետևողական լինել և պայքարել իրենց իրավունքների համար: Ինչ վերաբերում է աշխատողներին չգրանցելուն, ապա Շուշանիկ Բարսեղյանը նշեց, որ դա անընդունելի է, սակայն գործատուները գնում են այդ քայլին, որովհետև հարկային բեռը բավական բարձր է:

«Պետական հատվածը բյուջեից է գումար ստանում և աշխատողին թաքցնելու խնդիր չունի: Աշխատավարձերի վրա հարկային բեռը բավական բարձր է, որը պետք է վճարի գործատուն, դրա համար գործատուն և աշխատողն ավելի հարմար են գտնում փոխադարձ համաձայնության գալ և չկնքել աշխատանքային պայմանագիր»,-ասաց Շուշանիկ Բարսեղյանը:

Աշխատանքի և սոցիալական հարցերի նախարարության աշխատանքի և զբաղվածության վարչության պետ Թադևոս Ավետիսյանը նշեց, որ նման դեպքերում շատ դժվար է գործատուի խախտումը գտնելը:

«Եթե գործատուն և աշխատողը փոխհամաձայնության են գալիս, ապա վերահսկող մարմնի գործը դժվարանում է: Որքան էլ օրենսդրությունը բարելավվի, համապատասխանեցվի միջազգային չափանիշներին, միևնույն է նման դեպքերում, երբ կա փոխհամաձայնություն կողմերի միջև, խնդրի լուծումն ավելի բարդանում է»,-ասաց Թադևոս Ավետիսյանը:

Արհմիությունների կոնֆեդերացիայի նախագահի տեղակալ Բորիս Խառատյանն էլ բարձրացրեց վերահսկող մարմնի արդյունավետության խնդիրը: «Ժամանակին գործում էր Աշխատանքի պետական տեսչություն, կար համապատասխան օրենսդրություն, բայց այժմ այն վերակազմավորվել է և գործում է Առողջապահական պետական տեսչության հետ միրավորված, Առողջապահական պետական տեսչության անվան ներքո»,-ասաց Բորիս Խառատյանը:

Չնայած եղած խնդիրներին՝ բանախոսները նկատեցին, որ աշխատողների շրջանում տարեցտարի նկատվում է իրավագիտակացության բարձրացում, ինչը հանգեցնում է նրան, որ ավելանում են աշխատանքային իրավունքների հետ կապված դատական վեճերը:
