Բռնագանձման հետևանքով մարդիկ չե՞ն զրկվի իրենց բնակարաններից.«168 ժամ»

«ՀՀ կառավարությունն առաջարկում է լրացում կատարել «Դատական ակտերի հարկադիր կատարման մասին» օրենքում, որի նպատակը, ըստ հիմնավորման, պարտապանին հնարավորություն տալն է՝ իր գույքի վրա բռնագանձում տարածվելու դեպքում չզրկվել նվազագույն բնակապահովումից։ Փաստաբան Գևորգ Գյոզալյանը 168.am–ի հետ զրույցում ասաց, որ իր կարծիքով՝ առաջարկը լավն է։ Այժմ էլ օրենքը սահմանում է գույքի ցանկը, որի վրա չի կարող բռնագանձում տարածվել։ «Սա ինչ-որ նոր ինստիտուտ չէ։ Օրենսդիրն ինքն է որոշում, թե որ գույքի վրա կարող է բռնագանձում տարածվել։ Մեծ հաշվով այս օրենքը կարելի Է համարել այդ ցանկի լայնացում»,– ասաց փաստաբանը նշելով, որ փայտը երկու ծայր ունի, բայց իր պրակտիկայից գիտի դեպքեր, երբ պարտավորությունների հետ կապված մարդիկ անտուն են մնացել։ «Առնվազն տունը պետք է լինի այն անձեռնմխելի գույքը, որից մարդը չզրկվի և փողոցում չհայտնվի»,– ասաց փաստաբանը։
Նշենք, որ օրենքն առաջարկում է սահմանել, որ բռնագանձում չի կարող տարածվել միակ այն բնակարանի (այդ թվում բնակարանի հետ մեկ միասնական գույքային միավոր կազմող տնամերձ հողամասի և այդ հողամասի վրա առկա օժանդակ կառույցների) կամ դրա բաժնի վրա, որը պարտապանի համար հանդիսանում է մշտական բնակության միակ վայր, և որի գնահատված արժեքի 75 տոկոսը հավասար կամ ցածր է կառավարության կողմից սահմանված միակ բնակարանի իրացման համար նախատեսված նվազագույն գումարից։ Եթե միակ բնակարանն իրացվում է ՀՀ կառավարության որոշմամբ սահմանված գումարը գերազանցող գնով, ապա ՀՀ կառավարության կողմից սահմանված միակ բնակարանի իրացման համար նախատեսված նվազագույն գումարը վերադարձվում է պարտապանին։ Ըստ նախագծի՝ սահմանված դրույթները չեն տարածվում այն դեպքերի վրա, երբ գույքը գրավադրված է պահանջատիրոջ պահանջի ապահովման համար, ինչպես նաև, երբ բավարարվում են ալիմենտային, կյանքին կամ առողջությանը կամ հանցագործությամբ պատճառված վնասների հատուցման պահանջները»,–գրում է թերթը։
