ՀՀ կառավարությունը կողմ է ներմուծվող ապրանքների մասով մաքսանենգության ապաքրեկանացմանը

ՀՀ կառավարությունը հավանություն տվեց «Հարկերի մասին», «Մաքսային կարգավորման մասին» և մի շարք այլ օրենքներում փոփոխություններ և լրացումներ կատարելու մասին ՀՀ օրենքների նախագծերի փաթեթին:
ՀՀ պետական եկամուտների կոմիտեի նախագահի տեղակալ Վախթանգ Միրումյանի խոսքով՝ նախագծերի փաթեթի մշակումը պայմանավորված է Եվրասիական տնտեսական միությանը ՀՀ անդամակցության շրջանակում հարկային և մաքսային առանձին հարաբերություններ կարգավորող օրենսդրության, այդ թվում՝ քրեական և վարչական պատասխանատվությունների ներդաշնակեցման և դրանից բխող գործող իրավական ակտերում փոփոխությունների կատարման անհրաժեշտությամբ:
Վախթանգ Միրումյանի խոսքով՝ նախագծերի փաթեթով առաջարկվող անկյունաքարային մոտեցումներից մեկը քրեական օրենսդրությունով նախատեսված մաքսանենգություն հոդվածի ապաքրեականացումն է՝ ՀՀ ներմուծվող ապրանքների մասով:
«Դա նշանակում է, որ այս փաթեթի ընդունումից հետո ՀՀ ապրանքների ներմուծումը, որը կատարվել է մաքսային հսկողությունը շրջանցելով կամ որի մասով ներկայացված մաքսային հայտարարագրերում առկա են ոչ ճշգրիտ տեղեկություններ՝ չի դիտարկվելու մաքսանենգություն և չի կիրառվելու քրեական օրենսդրությամբ նախատեսված պատասխանատվությունը:
Նման դեպքերում տնտեսավարող սուբյեկտներին առաջադրվելու է վճարել պակաս վճարված մաքսային վճարները: Ինչպես նաև քրեական պատասխանատվությունը փոխարինվելու է վարչական պատասխանատվությամբ՝ մաքսային արժեքի 100 տոկոսի չ ափով: Այնուհետև, եթե դրանից հետո տնտեսավարող սուբյեկտները չեն փոխհատուցի պետությանը պատճառված վնասը, ապա արդեն նոր միայն կիրառելի կլինի «Քրեական օրենսգրքի» 205 հոդվածն այնպես, ինչպես դա կիրառելի է հարկերի չվճարման պարագայում»,- ասաց ՊԵԿ նախագահի տեղակալը՝ հավելելով, որ ապաքրեականացումը չի վերաբերում, մասնավորապես՝ թմրանյութերի, զենք-զինամթերքի, ռադիոակտիվ նյութերի , ինչպես նաև կանխիկ դրամի սահմանաչափը գերազանցող ներմուծմանը:
Իր հերթին, ՀՀ Նախագահի աշխատակազմի ղեկավար Վիգեն Սարգսյանը նշեց, որ փաթեթն ունի երեք չլուծված հարց:
«Մեկը վերաբերվում է սահմանադրական նորմի համաչափությանը, երկրորդը՝ փաթեթով նախատեսված սանկցիաների համապատասխանությանը, համաչափության հինավորմանը, որը թույլ է արված,և երրորդը վերաբերվում է նոր հասկացությանն` արժանահավատ տեղեկությունների չորոշվածությանը,այսինքն` բավականաչափ պարզաբանված չէ, թե ինչ է»,- ասաց Սարգսյանը: Նա կարևորեց նախագծում առկա բացթողումների լուծումը մինչ Ազգային ժողով ներկայացնելը:
Իր հերթին, ՀՀ Ազգային անվտանգության ծառայության պետի տեղակալ Արզուման Հարությունյանը հորդորեց այս պահին զերծ մնալ նման նախագծի ընդունումից, քանի որ Բելառուսում ևՂազախստանում նմանատիպ օրինագծեր չեն ընդունել և այնտեղ մաքսանենգության քրեականացումն ամբողջությամբ գործում է: Արձագանքելով` Միրումյանը նշեց, որ իրենք հիմք են ընդունել Ռուսաստանի մոդելը, որտեղ մաքսանենգությունն ապաքրեականացված է: ՀՀ վարչապետ Հովիկ Աբրահամյանն էլ նշեց, որ փաթեթով ճիշտ հարց է լուծվում և կարևորեց հարցի շուրջ բոլոր շահագրգիռ մարմինների հետ քննարկումների անցկացումն ու միասնական կարծիք ձևավորելը:
