Վարույթ է ընդունվել դատական ակտերի հարկադիր կատարողի կողմից լիազորությունները չարաշահելու վերաբերյալ քրեական գործը

Դավիթ Մ.-ի կողմից Ռաֆայել Գ.-ին վրաերթի ենթարկելու և անզգուշությամբ ծանր մարմնական վնասվածքներ պատճառելու դեպքի առթիվ ՀՀ քննչական կոմիտեի Երևան քաղաքի վարչությունում ՀՀ քրեական օրենսգրքի 242-րդ հոդվածի 1-ին մասով և 244-րդ հոդվածով հարուցված քրեական գործի նախաքննության ընթացքում ՀՀ ԱՆ ԴԱՀԿ ծառայությունից առգրավված «Բիզի գրուպ» ՍՊԸ-ի վերաբերյալ առկա կատարողական վարույթների զնն ությամբ պարզվել է, որ Երևան քաղաքի Կենտրոն և Նորք-Մարաշ վարչական շրջանների ընդհանուր իրավասության դատարանի կողմից տրված կատարողական թերթի հիման վրա ՀՀ ԱՆ ԴԱՀԿ ծառայության Կենտրոն և Նորք-Մարաշ բաժնում որոշում է կայացվել ավարտված կատարողական վարույթը վերսկսելու, բռնագանձման ենթակա՝ հիշյալ ՍՊԸ-ին սեփականության իրավունքով պատկանող գույքի վրա արգելանք դնելու մասին՝ արգելելով տնօրինել և օտարել արգելադրված գույքը: Այս մասին «Արմենպրես»-ին տեղեկացրին ՀՀ հատուկ քննչական ծառայո ւթյան լրատվական ծառայությունից:

2014թ. մարտի 27-ին պարտապանի գույքի վրա արգելանք դնելու մասին կազմվել է ակտ և թվով 28 «Միցուբիշի Լանսեր» մակնիշի ավտոմեքենաներն ի պահ են հանձնվել նույն ՍՊԸ-ի տնօրենին՝ պարզաբանելով գույքը վատնելու, թաքցնելու, օտարելու և փոփոխելու դեպքում քրեական պատասխանատվության մասին:

ՀՀ ԱՆ ԴԱՀԿ ծառայության Երևան քաղաքի Կենտրոն և Նորք-Մարաշ բաժնի աշխատակիցների կողմից 18.06.2014թ. և 19.06.2014թ. կատարված ստուգայցերի ընթացքում պարզվել է, որ արգելանքի տակ գտնվող գույքն ի պահ ընդունած անձի կողմից օտարվել է, և թվով 13 «Միցուբիշի Լանսեր» մակնիշի ավտոմեքենաները բացակայում են:

Փաստի առթիվ Երևան քաղաքի քննչական վարչությունում որոշում է կայացվել քրեական գործի նյութերով ՀՀ քրեական օրենսգրքի 345-րդ հոդվածի 1-ին մասով նոր քրեական գործ հարուցելու մասին:

Քրեական գործի ստուգմամբ պարզվել է, որ 24.09.2013թ. պարտապանի գույքի վրա արգելանք դնելու որոշում կայացնելուց շուրջ 6 ամիս հետո միայն՝ 27.03.2014թ. ՀՀ ԱՆ ԴԱՀԿ ծառայության Երևան քաղաքի Կենտրոն և Նորք-Մարաշ բաժնի հարկադիր կատարողի կողմից կազմվել է «Պարտապանի գույքի վրա արգելանք դնելու» ակտ և թվով 28 «Միցուբիշի Լանսեր» մակնիշի ավտոմեքենաներն ի պահ են հանձնվել «Բիզի գրուպ» ՍՊԸ-ի տնօրենին՝ պարզաբանելով գույքը վատնելու, թաքցնելու, օտարելու և փոփոխելու դեպքում քրեական պատասխանատվության մասին:

Բացի այդ, 18.06.2014թ. և 19.06.2014թ. կատարած ստուգայցերի ընթացքում պարզելով, որ արգելադրված գույքն ի պահ ընդունած անձի կողմից օտարվել է, ՀՀ ԱՆ ԴԱՀԿ ծառայության Երևան քաղաքի Կենտրոն և Նորք-Մարաշ բաժնի աշխատակիցների կողմից այդ մասին հաղորդում կամ զեկուցագիր չի ներկայացվել:

Երևան քաղաքի Կենտրոն և Նորք-Մարաշ վարչական շրջանների ընդհանուր իրավասության դատարանի  վճռով «Բիզի գրուպ» ՍՊԸ-ն ճանաչվել է սնանկ և այդ հիմքով որոշում է կայացվել կատարողական վարույթը կարճելու մասին:

Դեպքի առթիվ ՀՀ քրեական օրենսգրքի 308-րդ հոդվածի 1-ին մասի հատկանիշներով հարուցված քրեական գործն ընդունվել է ՀՀ հատուկ քննչական ծառայության վարույթ:

Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
