Բռնություն գործադրած ՃՈ աշխատակիցը կարող է զրկվել իր պաշտոնից

Արմավիրի մարզի ընդհանուր իրավասության դատարանում հարուցվել է քրեական գործ ճանապարհային ոստիկանության աշխատակցի կողմից իր լիազորությունների շրջանակից դուրս գործողություններ իրականացնելու համար:
Ըստ Դատական տեղեկատվական համակարգի՝ ՀՀ ոստիկանության ճանապարհապարեկային ծառայության ավագ տեսուչ Արտակ Ղազարյանին մեղադրանք է առաջադրվել այն բանի համար, որ նա «Ոստիկանության մասին», «Ճանապարհային երթեւեկության անվտանգության ապահովման մասին» ՀՀ օրենքների դրույթներով օժտված լինելով հասարակական կարգը պահպանելու, հասարակական անվտանգությունն ապահովելու, անձի կյանքն ու առողջությունը, իրավունքները, ազատություններն ու օրինական շահերը պաշտպանելու պարտականություններով, հանդիսանալով մշտապես իշխանության ներկայացուցչի գործառույթներ իրականացնող պաշտոնատար անձ` ծառայական գործունեության ընթացքում դիտավորությամբ կատարել է բռնության գործադրմամբ զուգորդված այնպիսի գործողություններ, որոնք ակնհայտորեն դուրս են եկել նրա լիազորությունների շրջանակից եւ էական վնաս են պատճառել անձի իրավունքներին, քաղաքացու եւ պետության օրինական շահերին:
Այսպիսով, Արտակ Ղազարյանը կատարել է հանցավոր արարք, որը նախատեսված է Քրեական օրեմսգրքի 309-րդ հոդվածի երկրորդ մասով: Ինչը պատժվում է ազատազրկմամբ՝ երկուսից վեց տարի ժամկետով, կամ էլ որոշակի պաշտոններ զբաղեցնելու կամ որոշակի գործունեությամբ զբաղվելու իրավունքից զրկելով՝ առավելագույնը երեք տարի ժամկետով:
