Քննիչը կալանավորվել է քննությանը խոչընդոտելու համար

Երեւան քաղաքի Կենտրոն եւ Նորք-Մարաշ վարչական շրջանների ընդհանուր իրավասության դատարանում հարուցվել է քրեական գործ քննիչի կողմից քննության բնականոն ընթացքը խոչընդոտելու դեպքի առթիվ:
Ըստ Դատական տեղեկատավկան համակարգի՝ Ոստիկանության նախկին քննչական գլխավոր վարչության Երեւան քաղաքի քննչական վարչության Կենտրոնականի քննչական բաժնի պետի տեղակալ Հայկ Ավագյանին մեղադրանք է առաջադրվել այն բանի համար, որ նա իրականացնելով կազմակերպական-տնօրինչական գործառույթներ, հանդիսանալով իշխանության ներկայացուցչի լիազորություններով օժտված պաշտոնակատար անձ, նույն բաժնում քննվող թիվ 13202214 քրեական գործի բազմակողմանի, լրիվ օբյեկտիվ քննությանը խոչընդոտելու նպատակով քրեադատավարական նորմերից չբխող գործողությունների կատարմամբ եւ ապօրինի բանավոր ցուցումներ տալով՝ միջամտել է գործով նախաքննություն կատարող, իրեն անմիջականորեն ենթակա քննիչ Շիրազ Գրիգորյանի գործունեությանը, այսինքն` խոչընդոտել է քննությանը:
Վերջինիս մեղադրանք է առաջադրվել Քրեական օրենսգրքի 332-րդ հոդվածի երրորդ մասով, որը նախատեսում է կամ նվազագույն աշխատավարձի երեքհարյուրապատիկից հինգհարյուրապատիկի չափով տուգանք, կամ առավելագույնը չորս տարի ժամկետով ազատազրկմամբ՝ որոշակի պաշտոններ զբաղեցնելու կամ որոշակի գործունեությամբ զբաղվելու իրավունքից զրկելով՝ առավելագույնը երեք տարի ժամկետով:
Քննիչի նկատմամբ որպես խափանման միջոց է կիրառվել կալանավորումը:
Դատարանը որոշում է կայացրել դատապարտել քննիչին երկու տարի ժամկետով ազատազրկման ՝ պետական ու տեղական ինքնակառավարման մարմիններում եւ կազմակերպություններում պաշտոններ զբաղեցնելու իրավունքից զրկելով մեկ տարի ժամկետով։
Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ,քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
