ՀՀ քննչական կոմիտեի Երևան քաղաքի քննչական վարչությունում ավարտվել է օտարերկրյա քաղաքացու` Երևանում վրաերթի ենթարկվելու դեպքի առթիվ հարուցված քրեական գործի նախաքննությունը: Ինչպես տեղեկացրին ՀՀ քննչական կոմիտեի դեպարտամենտի տեղեկատվության և հասարակայնության հետ կապերի բաժնից, 2014թ. դեկտեմբերի 26-ին՝ ժամը 05:30-ի սահմաններում, Երևանի Մաշտոցի պողոտայում` թիվ 42ա շենքի դիմաց, վրաերթի է ենթարկվել օտարերկրացի Գայե Ջոշարը, ով դեպքի վայրից շտապօգնության ավտոմեքենայով տեղափոխվել է «Սուրբ Գրիգոր Լուսավորիչ» բժշկական կենտրոն, որտեղ 2015թ. հունվարի 7-ին՝ ժամը 01:30-ի սահմաններում, մահացել է։

Քրեական գործի նախաքննությամբ պարզվել են Գ. Ջոշարին վրաերթի ենթարկելու հանգամանքները, առերևույթ հանցագործություն կատարած անձի ինքնությունը։

Նախաքննությամբ պարզվել է, որ քաղաքացի Ա. Գրիգորյանը 2014թ. դեկտեմբերի 26-ին՝ ժամը 05:30-ի սահմաններում, «Օպել-Վեկտրա» մակնիշի ավտոմեքենան շուրջ 40 կմ/ժամ արագությամբ վարել է Երևան քաղաքի Ամիրյան փողոցի կողմից Մաշտոցի պողոտայով Սայաթ-Նովա փողոցի ուղղությամբ ՝ ուղեմասի երկրորդ շարքով, հեռահար լույսերը միացված վիճակում։ 

Քննության նյութերի համաձայն՝ չհասած Մաշտոցի և Թումանյան փողոցների խաչմերուկին` վարորդը թույլ է տվել ՃԵԿ-ի 67 կետի պահանջին հակասող գործողություն, այն է՝ երթևեկելի ուղեմասում պառկած Գ. Ջոշարին  հայտնաբերելու հնարավորություն ունենալու սկզբնապահից սկսած արգելակումով չի կանգնեցրել ավտոմեքենան, վրաերթի է ենթարկել և անզգուշությամբ պատճառել մահ։

Մինչդատական վարույթում ձեռք բերված ապացույցների հիման վրա՝ վարորդին մեղադրանք է առաջադրվել ՀՀ  քրեական օրենսգրքի 242-րդ հոդվածի 2-րդ մասով։

Քրեական գործը՝ մեղադրական եզրակացությամբ, ուղարկվել է նախաքննության օրինականության նկատմամբ հսկողություն իրականացնող դատախազին։
