Լոռու մարզի ընդհանուր իրավասության դատարանը՝ նախագահությամբ դատավոր Լուսինե Աբգարյանի, մասնակի բավարարելով քննչական կոմիտեի քննիչ Էդիկ Կոստանյանի կողմից ներկայացված միջնորդությունը, Ստեփանավանի բնակչուհի Սուսաննա Բարոյանի նկատմամբ խափանման միջոց կալանք ընտրելու վերաբերյալ, մեկամսյա կալանքի որոշում է կայացրել:

Քննիչը կնոջ նկատմամբ երկամսյա կալանք էր պահանջում՝ իր միջնորդության մեջ հիմք բերելով այն հանգամանքը, որ նախկինում Քր. օր. 137-րդ հոդվածով (Սպանության, առողջությանը ծանր վնաս պատճառելու կամ խոշոր չափի գույք ոչնչացնելու սպառնալիքը, եթե այդ սպառնալիքն իրականացնելու իրական վտանգ է եղել), հարուցված քրեական գործով Սուսաննա Բարոյանի նկատմամբ արդեն ընտրված է եղել խափանման միջոց՝ ստորագրություն չհեռանալու մասին, որից հետո նույնական փաստական հանգամանքների վերաբերյալ նույն անձի կողմից ստացված ևս մեկ հաղորդման հիման վրա ևս մեկ դրվագով և նույն՝ Քր.օր. 137-րդ հոդվածով, քննիչը երկրորդ գործն է հարուցել և մեղադրանք առաջադրել Սուսաննա Բարոյանին: Այսինքն՝ քննիչի ներկայացմամբ, խափանման միջոց ընտրված լինելու պայմաններում անձը նորից կատարել է հանցագործություն:

Սակայն, ըստ մեղադրյալի շահերի պաշտպան, Հելսինկյան քաղաքացիական ասամբլեայի Վանաձորի գրասենյակի փաստաբան Արայիկ Զալյանի, դատարանում կալանքի քննարկման ժամանակ քննիչի ներկայացրած փաստաթղթերով և ապացույցներով չի հիմնավորվել այն հանգամանքը, որ Սուսաննա Բարոյանը վտանգ է ներկայացնում իր դեմ հաղորդում տվող անձի համար: Քննիչն ընդամենը հղում է արել առաջին գործով ձեռք բերված ապացույցներին, որոնք արդեն իսկ առաջին մեղադրանքով դատարանում են: Իսկ դարձյալ իր կողմից առաջադրված երկրորդ մեղադրանքով որևէ առարկայական ապացույց չի ներկայացրել, որը կվկայեր, որ Սուսաննա Բարոյանին վերագրվող արտահայտություններն սպառնալիք են պարունակում և այն էլ այնքան իրական, որ դրա համար կարելի է քրգործ հարուցել և մեղադրյալին կալանավորել:

Փաստաբանը կարծիք է հայտնում, որ երկրորդ մեղադրանքն առաջադրելու համար էլ քննիչը բավարար հիմքեր չի ունեցել: Կալանքի որոշումը միանշանակ բողոքարկվելու է: Փաստաբան Զալյանը ուշադրություն է հրավիրում այն հանգամանքին, որ երկու գործով էլ տուժողն ու բողոքողը միևնույն անձն է, և որ երկու գործի քննությունն էլ միևնույն քննիչի կողմից է կատարվում: «Այսինքն՝ այն գործը, որ գտնվում է դատարանում և դրանից հետո երկրորդ հաղորդման հիման վրա նյութերի նախապատրաստական աշխատանքներն ու քրեական գործի հարուցումը նորից կատարվել են քննիչ Կոստանյանի կողմից: Ստացվում է, որ Կոստանյանը ստանձնել է տուժողի անձնական քննիչի կարգավիճակ: Մի՞թե ՀՀ քննչական կոմիտեում այլ քննիչներ չկան կամ ի՞նչ սկզբունքով է կատարվում գործերի հանձնման ընթացակարգը»,- ասում է Արայիկ Զալյանը:
