ՄԻԵԴ-ը ճանաչել է քաղբանտարկյալներ Յունուսների խոշտանգումներն Ադրբեջանում

Մարդու իրավունքների եվրոպական դատարանը (ՄԻԵԴ) այսօր հրապարակել է ադրբեջանցի իրավապաշտպաններ Լեյլա եւ Արիֆ Յունուս ամուսինների գործով վճիռը, որում ՄԻԵԴ-ը ճանաչել է Եվրոպական համաձայնագրի 3-րդ հոդվածով (խոշտանգումների արգելում) նրանց իրավունքների խախտումն Ադրբեջանում: ՄԻԵԴ-ը վճռել է, որ Ադրբեջանի կառավարությունը պարտավոր է 13 հազարական եվրո փոխհատուցում կատարել նրանցից յուրաքանչյուրին, եւ եւս 4 հազար եվրո վճարել դատական ծախսերի դիմաց :
Այս մասին, ինչպես հաղորդում է«Արմենպրես»-ը, հայտնում է ադրբեջանական «Թուրան» լրատվական գործակալությունը` նշելով, որ ՄԻԵԴ-ը պարզել է, որ մինչ դատական գործընթացը Յունուս ամուսիններին անհրաժեշտ որակյալ բժշկական օգնություն չի ցուցաբերվել, ինչը գնահատվել է որպես խոշտանգում:
ՄԻԵԴ-ը նաեւ վճռել է, որ Ադրբեջանի կառավարությունը չի հետեւել Եվրոպական համաձայնագրի 34-րդ հոդվածով (անհատական բողոքներ) իր պարտավորություններին:
Փաստաբան Ջավադ Ջավադովը «Թուրան»-ին հայտնել է, որ այդ հոդվածը կիրառվել է այն բանի հետ կապված, որ ամուսինների պաշտպան Խալիդ Բագիրովը հեռացվել է փաստաբանական գործունեությունից եւ թույլ չի տրվել շփվել ձերբակալված Յունուսների հետ:
Լեյլա եւ Արիֆ Յունուսները 2015 թվականի օգոստոսի 13-ին ծանր հանցագործությունների դատարանի կողմից դատապարտվել են համապատասխանաբար 8,5 եւ 7 տարի ժամկետով ազատազրկման` դատարանի կողմից կոպտորեն խախտելով միջազգային չափանիշները եւ պատշաճ դատական գործընթացը: 2015 թվականի դեկտեմբերի 9-ին նրանց պայմանական ազատ են արձակել 5 տարի փորձնական ժամկետով:
Երկու իրավապաշտպաններն էլ ձերբակալվել էին իշխանություններին քննադատելու եւ հասարակական գործունեության համար:
Ադրբեջանում Լեյլա Յունուսը եւ նրա ամուսին Արիֆ Յունուսը մեղադրվում են նաեւ, իբր, Հայաստանի օգտին լրտեսություն կատարելու մեջ, սակայն, նրանց հետապնդելու իրական պատճառը Ադրբեջանում առկա 100-ից ավելի քաղաքական բանտարկյալների խնդրի ակտուալացումն ու միջազգային կազմակերպություններին արված` Բաքվում 2015 թվականի մայիսին անցկացված Եվրոպական խաղերը բոյկոտելու մասին կոչերն էին: Amnesty International կազմակերպությունը Լեյլա եւ Արիֆ Յունուսներին «խղճի բանտարկյալներ» է ճանաչել:
2016 թվականի ապրիլի 19-ին միջազգային կազմակերպությունների համառ կոչերից հետո Ադրբեջանի իշխանությունները թույլատրել են բուժման համար մեկնել արտասահման:
Յունուսների ընտանիքը ներկայում բնակվում է Ամստերդամում եւ դիմել է այդ երկրում ապաստան ստանալու խնդրանքով:
