Վեց զինծառայող մեղադրվում է վաշտի հրամանատարի նկատմամբ բռնանալու մեջ

ՀՀ քննչական կոմիտեի զինվորական քննչական գլխավոր վարչության 8-րդ կայազորային քննչական բաժնում քննվող քրեական գործով 6 զինծառայողի մեղադրանք է առաջադրվել՝ վաշտի հրամանատար, կապիտան Կ.Խաչատրյանի նկատմամբ բռնություն գործադրելու համար։ Այս մասին«Արմենպրես»-ին տեղ եկացրին ՀՀ քննչական կոմիտեի դեպարտամենտի տեղեկատվության և հասարակայնության հետ կապերի բաժնից՝ հավելելով. «Ննախնական քննության տվյալներով՝ 2016թ. մայիսի 16-ին՝ ժամը 21:30-ի սահմաններում, վաշտը ստուգելու ընթացքում վաշտի հրամանատար, կապիտան Կ.Խաչատրյանը պարզել է, որ շարքում ալկոհոլ օգտագործած զինծառայողներ կան, որի մասին զեկուցել է գումարտակի հրամանատարին, ապա պահանջել, որ շարքից դուրս գան ալկոհոլ օգտագործած զինծառայողները: Թվով 6 զինծառայող դուրս են եկել շարքից և ալկոհոլ օգտագործելու համար կապիտանի կողմից արված դիտողության կապակցությ ամբ վիճաբանել վերջինիս հետ, ձեռքերով, ոտքերով հարվածել նրան։ Վիճաբանությունը շարունակվել է սպայական վրանի մոտ, որտեղ դարձյալ բռնություն է գործադրվել Կ.Խաչատրյանի նկատմամբ՝ պատճառելով մարմնական վնասվածքներ։
Ձեռք բերված ապացույցների հիման վրա՝ 6 զինծառայողի մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 358-րդ հոդվածի 3-րդ մասի 1-ին կետով (մի խումբ անձանց կողմից զորամասում կամ զինվորական ծառայություն կրելու այլ վայրում պետին (հրամանատարին) ծեծելը կամ նրա նկատմամբ այլ բռնություն գործադրելը)։
Քննիչը միջնորդություն է ներկայացրել դատարան՝ բոլոր 6 մեղադրյալների նկատմամբ որպես խափանման միջոց կալանավորումը կիրառելու վերաբերյալ, ինչը բավարարվել է։ Դատարանը միաժամանակ մեղադրյալներից երկուսի նկատմամբ կիրառել է այլընտրանքային խափանման միջոց՝ գրավ։
Քրեական գործի նախաքննությունը շարունակվում է:
Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրամեղավորություննապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինականուժի մեջ մտած դատավճռով»:
